I agree with you, also got the same situation with SSN. They followed the name on the passport even though I got marriage certificate.

Correct.

I had the impression that the clerk was going to say " I don't care about your marriage certificate. Your maiden name is on your visa, I-94, birth certificate and passport and that's the name I'm going to use" :D

You need to apply for the SSN two weeks before the I-94 (the "90 days") expires, doesn't matter when you're married. As long as you're within this window, if you bring your marriage certificate and her passport etc, she should be able to get an SSN in her married name. The fact that she wants to change her name is a good reason to NOT have applied for one before you were married-- just another trip to the office for something you were able to do without for a few weeks.

Also, you should be able to get her on a joint bank account without an SSN.

In theory that should work fine but during my time here on VJ I have seen sooo many cases where people couldn't get SSN after marriage, especially after changing names. So based on that I will always recommend every K-1er to get the SSN within the first 2-3 weeks in the US, always before marriage, planned name change or not. It's better to have a SSN in your maiden name than having to wait to get the SSN until your EAD shows up.

I get that-- for sure. In our case (and we did have a name change involved), it really was not important at all that he have an SSN until EAD. We did try within the 75 days (post marriage, with certificate) but the long story of that is that I sent my husband and our friend who was driving him on day 70ish, but the line was long so they didn't stay. Then it was the weekend, then there was a ton of snow and then when they tried again, it was too close to his I-94 expiry. But it would have worked, they put in the paperwork with the "married name" but he got sent a denial letter in his "married name" stating the I-94 date and nothing else.

For us, because it wasn't pressing that he have an SSN, we were fine waiting (and it was easier because we don't drive and therefore had to rely on the goodwill of a friend willing to drive and hang around a social security office heh). But I think for people for whom it is critical (they need it for a drivers licence, and they need to be able to drive), obviously getting it ASAP in maiden name is preferable.

Marriage/ AOS Timeline:

23 Dec 2015: Legal marriage

23 Jan 2016: Wedding!

23 Jan 2016: "Blizzard of the Century", wedding canceled/rescheduled (thank goodness we were legally married first or we'd have had a big problem!) :sleepy:

24 Jan 2016: Small "civil ceremony" with friends and family who were snowed in with us. December was a bit of a secret and people had traveled internationally and knew we *had* to get married that weekend, and our December legal marriage was nothing but signing a piece of paper at our priest's kitchen table, without any sort of vows etc so this was actually a very special (if not legally significant) day. (L)

16 Apr 2016: Filed for AOS and EAD/AP (We delayed a bit-- no big rush, enjoying the USCIS break)

23 Apr 2016: Wedding! Finally! :luv:

27 Apr 2016: Electronic NOA1 for all 3 :dancing:
29 Apr 2016: NOA1 Hardcopy for all 3
29 Jul 2016: Online service request for late EAD (Day 104)
29 Jul 2016: EAD/AP Approved ~3 hours after online service request
04 Aug 2016: RFE for Green Card (requested medicals/ vaccination record. They already have it). :ranting:
05 Aug 2016: EAD/AP Combo Card arrived! (Day 111)
08 Aug 2016: Congressional constituent request to get guidance on the RFE. Hoping they see they have the form and approve!

K-1 Visa Timeline:

PLEASE NOTE. This timeline was during the period of time when TSC was working on I-129fs and had a huge backlog. The average processing time was 210+ days. This is in no way predictive of your own timeline if you filed during or after April 2015, unless CSC develops a backlog. A backlog is anything above the 5-month goal time listed on USCIS's site

14 Feb 2015: Mailed I-129f to Dallas Lockbox. (L) (Most expensive Valentine's card I've ever sent!)

17 Feb 2015: NOA1 "Received Date"
19 Feb 2015: NOA1 Notice Date
08 Aug 2015: NOA2 email! :luv: (173 days from NOA1)

17 Aug 2015: Sent to NVC

?? Aug 2015: Arrived at NVC

25 Aug 2015: NVC Case # Assigned

31 Aug 2015: Left NVC for Consulate in San Jose

09 Sep 2015: Consulate received :dancing: (32 days from NOA2)

11 Sep 2015: Packet 3 emailed from embassy to me, the petitioner (34 days from NOA2).

18 Sep 2015: Medicals complete

21 Sep 2015: Packet 3 complete, my boss puts a temporary moratorium on all time off due to work emergency :clock:

02 Oct 2015: Work emergency clears up, interview scheduled (soonest available was 5 business days away--Columbus Day was in there)

13 Oct 2015: Interview

Can someone elaborate on the I-94.? Is this a necessary document to have?

You use it for many things to prove that you entered the country legally and it shows to what date your stay in the US is valid. You send copies of the i-94 with your AOS package, most of us send a copy with both the i-485, i-131 and i-765.

Assuming she can't get a SSN# before the green card, what evidence did people use as proof of a legit relationship that doesn't require a SSN#? (excluding banks).

Becci391, so did you get married first like we did before the SSN?

I got my ssn with combo card( ead/ap) on my married name as it on combo card.

I had with me 1. Printed application, 2. Combo card 3. Passport. (I did have my marriage cert. but no one asked for it)
