Only that person eligible to file form i-864 who have filed atleast 3 years tax returns... 

i really aprriciat it if u guide me and help me to sort out that problem..

My suggestion is to call the NVC to clarify your questions. :)

@JBMG thanks alot dear.. but i have made several calls to the NVC they gave the same reply that they dont give advices :/

Ok, well this is the thing. This is what I've understood, i'm no lawyer and I'm an applicant just like you.

 

The sponsor doesn't have to submit the last 3 tax returns. They only have to submit the most recent year. With this, you qualify. For 2014, and 2015. The sponsor writes a letter to explain that he didn't work those years, that he didn't receive any w2 forms, nor any income. Since he didn't have an income, he wasn't required to file taxes. Make sure he signs the letter..  

 

This site explains how you can get a letter from the IRS saying that he didn't file for those years.

I hope this helps.. If you're worried, then he can get a joint-sponsor. The joint-sponsor doesn't have to live in your household or be a family member.

Why? Where does it say that? 

 

I'm the sponsor for my spouse and I didn't file taxes last year.. I'm using assets and have seen others using assets and get approvals without problems..

@Returnee thanks dear for ur advice many people are so confuesd on that topic lolz i further asked my people about that and i think @JBMG is right Petitioner Spouncer can file i-864 with only one year tax returns. My best wishes for both u and thanks alot to sharing ur ideas once again thanks alot : )

The sponsor needs to provide only the most recent year unless they selected the three most recent years on their I-864 form. If you believe additional returns may help you to establish your ability to maintain sufficient income, you can submit transcripts or photocopies of your Federal individual income tax returns for the three most recent years.

 

If you are using a joint sponsor, then the same applies.  EACH sponsor including joint sponsors must submit the following documentation with their I-864:

  • IRS tax transcript OR complete copy of the filed tax return including all relevant W2s and 1099s
  • W-2s are especially important if filing status was married filing jointly for the tax year
  • Second and third most recent tax years are optional 
  • If are using the income of persons in the household or dependents to qualify as a sponsor, they must also submit a separate Form I-864A, Contract Between Sponsor and Household Member, for each person whose income will be used to qualify
