Hi all, 

 

We submitted our AOS with EAD back in July 2016. We initially had a RFIE (August) and returned. After sending back the required information, the status of our AOS was never updated on the site, and still to this day reads:

On August 24, 2016, we mailed a request for initial evidence for your Form I-485, Application to Register Permanent Residence or to Adjust Status, Receipt Number XXXX. The request for evidence explains what we need from you. We will not take action on your case until we receive the evidence or the deadline to submit it expires. Please follow the instructions in the request for evidence. If you do not receive your request for evidence by September 23, 2016.

 

There was a due date on this RFIE, so would expect that if they haven't received it - we would have received a notice stating that our application had been denied. We called the office several times to see if they were able to confirm receipt, and each time we were met with the response that if we had sent it, they would have it (we also got notice of the package having been delivered). 

 

Along with that, my husbands EAD was approved on 1/2017 - so we have that. I just feel a bit uneasy about the fact that the status online hasn't been updated since us sending in our initial evidence. 

 

Does anyone know if USCIS would have processed the EAD separate to receiving the evidence? Any insight is appreciated - Thanks all!

Have you tried making an infopass appointment? They may be able to provide additional assistance. You won't get very far with them on the phone. I would say that you are heading to the point where more aggressive inquiry needs to be made about the status of your case.. you've been waiting a while not just on their response but to know what is going on with your case entirely. Start with an infopass, and then escalate it with a senator if need be. Yes it is possible that the status tracker never updates, but that doesn't give you much peace of mind.

Good idea! I've looked into this in the past, however haven't scheduled one. Looks like they book up quickly so will definitely keep an eye out for an opening. Thank you for the direction!

Quick update on this one - we made an Infopass apt. and learned that someone in San Antonio has opened our file this week (after a long period of inactivity). The person we spoke with told us to expect an interview within the next two months. So this definitely helped to shed some light on our case. He was not able to comment on why the status hadn't been updated online, but told us to come back if we don't hear anything by mid-July.
