Lifting Conditions - RFE

Hi to all,

I am May 2016 filer for lifting conditions of my 2 year green card, I  haven't heard until April 28,2017, the letter said they all these RFE.

 

I have a lot of question:

     UTILITY BILLS - me and my husband don't have joint name in our bills

     THIRD PARTY AFFIDAVIT - can be neighbor, friends or family? 

     WAITING TIME - how long the process after RFE received by USCIS?

     WORRIED - my extension will be August 16, 2017 and I am worried about my status since I am currently working right since July 2015, 

                         I have to to give a copy of my green card to Human Resources to prove that I am legal to work, what I am gonna do?

     EVIDENCE that me and my husband have made estate, health and financial planning arrangements with each other??? -                                                        * a will

                               * a trust or * a durable power of attorney for health care or property or both....????

 

     ANY SUGGESTION FOR ADDITIONAL EVIDENCE

 

WE ARE MARRIED FOR 4 YEARS THIS COMING SEPTEMBER 2017.

Hi Chona.  Here are some ideas.

 

Many utilities will NOT put the account in two names.  They are trying to determine two things:

 

1.  Do you share your home and the resulting bills?

2.  Are you committed enough to each other to name each other as decision makers if you had a medical emergency, and have you named each other as beneficiary in your wills?

 

Yes, you have been married for 4 years, but your packet did not give the officer the answers he/she sought.

 

Here are things to suggest:

 

1.  How are your utility bills paid?  Are they paid from a joint checking account?  If so, then print out a selection (maybe one per quarter) and highlight the checks or the online payments to the utility companies.  Did you include copies of both of your driver's licences that show the same address in your original packet?  Did you include a rental lease with both of your names on it?  If only your spouse's name is on the lease are you authorized by the landlord to live in the house/apartment?  Did you have a mortgage payment on a house that is paid from your joint account?

 

Do you have cellphones?  Are both of your phones on the same account?  If not, do both of the bills come to the same address?  Either send in copies (multiple!) of the cellphone bill with both of your phone numbers highlighted, or send copies of BOTH bills (same months) showing the same address on the bill.  Do you each pay for separate utility bills (he pays electricity, you pay gas, for example)?  Send in copies (again, multiple) showing the bills are delivered to the same address.

 

Think about what they are really looking for.  They want proof that you live together and that you are both sharing responsibility for paying for your house.

 

2.  Have you planned for the future?  Nothing proves that you are in a committed relationship than wills and medical powers of attorney.  If your spouse were to be brain-injured in an accident, who will make the medical decisions?  If you were to get Alzheimer's disease, who would take care of your affairs?  Wills and powers of attorney show you rely on each other for important life and death decisions.

 

3.  As far as affidavits are concerned, choose people who have known you throughout your marriage, who can attest that you are a bonafide couple (maybe a priest or minister, a law enforcement person or a long-term neighbor).  They should talk about when and how they met you, where you live, how they know you, and that they attest to the fact that you are a bonafide married couple.

 

Good luck to you.  After you send in the information, the decisions usually come within about 30 days.  A lot will depend upon how detailed and complete your response is.

 

Write a cover letter that explains what you are sending.
