I would be thankful if someone share their experience:

- I and my wife are US Citizens. I am sponsoring my biological mother to the US under IR5 visa. Currently I am back to school so I don't have any income. My wife stays at home to take care of my children so she doesn't have any income. My school scholarship covers all our expenses. I can produce tax transcript showing income for 2014, 2015, however 2016 we have very limited income due to me going back to school (less than 10k).

- My auntie-cosponsor has income of 45K. Their family is of two people and she already sponsored one different person. So should I count her household of 3? She needs to file form I-864A? Does she need to request return transcript or a copy of tax return is fine?

- Does my wife need to file the cosponsor form I-864A? 

- Here is my assumption for the checklist of documents that I need to send: I-130, my tax return of 2016, I-864 (I will file), I-864A (my cosponsor - auntie), her tax return 2016, last 3 month paycheck stubs, my notarized birth certificate, and checks to pay for the fees of I-130 and I-864.

Am I missing anything? Please advise. Thanks,

yes, your aunt files the i864, not the i864

 

the i864A is for immediate relatives who live in the same household, such as parents and siblings

 

you fie an i864 as the primary sponsor, your aunt will file another i864 as your only joint sponsor

 

she needs to send proof of citizenship or LPR, taxes, or tax transcripts, employment letter if she can and paystubs

 

now the i864 is sent at a later stage if your mom lives in her country. for now it's only the i130, you will most likely need the i864s next year or at the end of this year the least, but not now

Can I include filled out I-864 form and associated documents in the same envelope of I-130 to expedite the paperwork? Thanks.

hi

 

no, they will go to different service centers. you send the i130, it is approved, the approved i130 will be sent to the NVC, the NVC is a service center for those who will be going for consular processing in their countries of origin, it is there where immigration will request the payment for the affidavit of support, then you will be  able to submit the affidavits of support plus financial documents

 

one step at a time
