Hi,

When you come on a K-1 visa and you go to apply for a Social Security card do you need to have temp EAD? I assume you don't since no one really issues EAD at airports anymore. You just need to bring your passport, a second ID and fill out the form right?

Timeline

All you need to show is Passport, Birth Certificate, and a valid I-94 card with at least 2 weeks left before it expires. K-1 is considered to be "work authorized" With or Without the stamp.

After my fiance had been in the U.S. for a week he applied for his SSN. All he needed was his passport and the I-94 (which is stapled in there). It was fast and easy (check out our timeline).

11/2004 - Met in Brazil

09/2006 - Apply for K1

03/2007 - K1 approved

04/2007 - Apply for AOS & EAD

07/2007 - EAD approved

01/2008 - Conditional Residency approved

11/2009 - Apply to remove conditions

02/2010 - Permanent Residency approved

11/2010 - Apply for Citizenship

03/2011 - Citizenship approved

07/2011 - Moved back to Brazil

After my fiance had been in the U.S. for a week he applied for his SSN. All he needed was his passport and the I-94 (which is stapled in there). It was fast and easy (check out our timeline).

My then fiance also applied within a few days of getting here. I was asking for a friend and I wasn't sure if it mattered or not that mine had temp EAD and my friends fiance won't. Thanks!

hey Sarah! :thumbs: How's it going?

All Mark took was his passport & birth certificate. He did not have the EAD stamp in his passport & he then received a SS card that had " Valid for Employment only with DHS Authorization" written opn it.

Now he has his GC he has applied for another SS card without the endorsement on it.

Technically ( according to the SSA) K-1 holders are allowed to work upon entry to the US; however K-1 holders lack the proof ( as required by the employers I-9 ) unless they have the temp EAD ( from the airport) or GC/EAD from DHS....

Oh..... and PS..... I would recommend your friend getting the temp EAD at the airport if it is at all possible. I know work has to stop when it expires, but OMG 3.5 months at home nearly drove Mark nutso ( especially because he got a job offer [ pending auth] not long after he got here.
