all turned out pretty quick for you. I wonder if exact location in NoVA determines your oath ceremony location. I have seen people being scheduled all over the place for Oath.

It did turn out pretty fast. I live in Alexandria and I am not sure if that was a factor in the quick turn around because I have seen people living in the same area being scheduled in DC. I actually expected to be schedule in DC.

Lawyer explained to me if I understood well, that they don’t  actually file lawsuit, they just give Uscis kind On warning that they will sue them if they don’t make decisions and in 100 percent on cases they make it.

Will you send this warning? I talked with the lawyer and tol me that filling a law suite is very expensive and not all immigration lawyers do it. Please let me know your updates. Thanks.

I don’t know yet. I talked with L2 officer two days ago , he told me they my file is in Washington ( where I got my green card)

but they will send to Chicago shortly. Every time they tell me something different. I contacted 2 lawyers in Chicago both of them charge $2500 for WRIT on Mandamus. After that they told me you got your decision shortly ( approved or denied) . USCIS lawyer almost never go to Court. It is been 130 days from my interview.

Yes I got gc , after that I moved from Washington to Chicago. It was 5 years ago. I got interview in Chicago on June 18 everything  went smooth , officer was really cool but I got paper “decision can not be make”  and he told me my file is lost. After 90 days I started with service requests and I called 800 number multiple times. They have never told me that my file is lost. They kept saying “pending and reviewing” . Last time L2 officer told me that file is in Washington. Really confusing and frustrating. I ll wait two more weeks and I ll hire the lawyer. I don’t feel comfortable to handle on court vs USCIS case by myself .

Honestly, I don't lightly advocate suing USCIS but yours is the exception. If they've told you your file is "lost," believe them. You could be waiting years before getting a decision, as no desk officer can adjudicate your case without your file. You need to force action by a senior manager, like a USCIS director, and you can only do that by:

 

- Asking the CIS Ombudsman to intervene, but that could take months and months (Ombudsman pressure is no different than your Congressional rep's, in my view); or

- Filing a 1447(b) suit (not a Writ of Mandamus), which is a Petition for a Hearing on Naturalization in your local district court. They'll suddenly "find" your file when a judge is looking over their shoulder.

Thank you aircraft. That I just received in my uscis inbox. I have never received such notice and I don’t know what they need from me. After that I called them and spoke with L2 officer they told me they don’t need anything at this point. Very very odd.

Hi all!

 

I discovered this forum way too late - I only knew this existed about one week ago - when I was getting worried about my oath ceremony. But since then, I have literally come here every day to read everyone's posts/timelines. When I read about the good news, they gave me hope, and I am so happy for those who already completed the journey. When I read about how people were just waiting and not knowing when it would happen, I could totally relate to the anxiety and frustration. I wanted to share my timeline just to show my appreciation. This forum has given me so much information!

 

3/4/2019 - application submitted

3/27/2019 - biometrics taken

6/24/2019 - case was transferred from MD office to DC office

8/12/2019 - interview was scheduled

9/19/2019 - interview (approved on the same day)

10/25/2019 - oath ceremony was scheduled

11/13/2019 - oath ceremony in VA

Interesting. Seems like: 1) they have issued an RFE, which you didn't receive; or 2) there is an unresolved security issue, which would be serious and could cause major delays; and/or 3) they're just trying to cover their legal behinds with documentation, however late it may be. Time to get aggressive. Here's how I would proceed:

  • If you don't get any notice on your online account after a day or two, I would respond via Inbox saying that you didn't get any Notice of Continuance and that it has now gone past 120 days since your interview and you would appreciate a decision (you want to make sure you put it in writing). The reason is that you usually have about 30 days to respond to an RFE (which has long passed) or your case is considered abandoned, so you want to have documented that you did not receive any RFE after your interview. 
  • Contact your Congressional rep and the CIS Ombudsman immediately for case assistance.
  • If it's a security issue (I don't know your nationality/religion/criminal history), only a judge can order them to speed up the process. Maybe. Time to talk to a (good) lawyer. Edit: Same goes if they've truly lost your file.
