Hey everyone my wife and I filed for green card in December and we were rejected due to an issue with me bank and we never received anything from USCIS to resolve the filing fee so our petition was rejected due to improper filing fee now we are refilling in and we have to fill out all new forms because we never received our original. But they are a couple questions on I 485 and I 765, that ask if we have ever applied for adjustment of status and if we have applied for EAD. Now do we need to answer yes? Our case was never denied just rejected. I called USCIS and that was a waste of time as they said they can't help me fill out the form yet I asked a simple question. Anyways long story short we aren't sure what to put. Yes or no. They also ask for reason it was denied. Well it wasn't denied it was rejected. To me rejected and denied are two completely different meanings.

If you never received a case number from them for the original AOS filing, then I would put "No" myself since it was merely rejected for wrong payment..

 

They never returned the check/money order or any paperwork at all? Normally it all gets returned.

08/15/2014 : Met Online

06/30/2016 : I-129F Packet Sent

11/08/2016 : Interview - APPROVED!

11/23/2016 : POE - Dallas, Texas

From sending of I-129F petiton to POE - 146 days.

 

02/03/2017 - Married 

02/24/2017 - AOS packet sent

06/01/2017 - EAD/AP Combo Card Received in mail

12/06/2017 - I-485 Approved

12/14/2017 - Green Card Received in mail - No Interview

Hrm. I'd just put "Yes" for filing before, and reason for 'denial' is "Improper I-485 fees, case rejected". I mean, if I were the officer reviewing that, it'd make sense to me and they'd see that in their system, too.

 

EDIT: I forgot about the case number. If you never got a case number, then say "no", otherwise do the above.

Nope never recieved anything back no petition no RFE. We did get deferal notice after we recieved our rejection NOA. We did get case numbers as we had her biometrics and everything. I'm going to assume we will need to answer yes and just put down why. Damn government.
