Totally agree!  It's been idol for days now!  Over 100 left for that day. At 3-4 a day will take months.

I always get emotional when I'm in the scan...I feel like I'm "back to existing!" 😂

I got a text at 1:20am while I was asleep and I thought first I was dreaming, then I was approved...the I wake up and I had to understand they received our response 😃 Still a good thing!

I’m no expert but your Cédula states your “civil status” plus what ever official document you can request from el registro civil will serve as proof of what they are asking, just make sure you have it officially translated to English before submitting. I think it will also be a good idea to include the part of the constitution stating same sex ban. (Que retraso el de nuestro país :( ) smh

USCIS is asking for court/legal documents proving you are not in a legal marriage and/or civil union. Identification is not court document proof. 

 

And while your translated statement you're gonna write says that same sex marriage are not recognized in Ecuador, domestic partnerships are recognized which again is a legal civil union. Domestic partnerships are recognized in the US as legal civil unions. 

 

So, I would advise you follow the instructions USCIS has asked you to do in order to provide whatever proof you need to prove what they're asking you.

@Trinab80 I thought this was deja vu.... @MariaB Soria I did speak to an Atty from my office, his expertise is Insurance Law but me and him thought just off the top of her heads  this may bring you an issue. You as the US Citizen entered into a Civil Union which is recognized by the USCIS as marriage, in addition an American company recognized your Union here in the US as legal enough here to issue benefits that can only be obtained by your "spouse". Again as I stated before, it is my opinion that USCIS recognizes your union as a marriage, therefore making you ineligible for the benefit you are seeking. Thus, the RFE to prove you are single, which means they have evidence that you are married. Just out of curiousity, we know you sent the Civil Union Documents to USCIS, did you send the Insurance Documents or work benefits that you added her to in as evidence as well ? Like I said you can get documents showing a "no record" search from your local clerk, but I'm sure your documents list a notary in another jurisdiction which doesn't help your case at all. This really is basically about how much time you want to spend on this, this type of RFE will delay your decision months, then you may get a denial after all that wait, which in my opinion may be inevitable. So basically, you just need to decide, send the documents you have and wait, or pull the petition now and refile a Spousal. TBH, I really hate to say it again, that's why I always tell people when dealing with government agencies or Insurance companies, never supply too much information. It opens the door for more questions !!! It's a really thin line when dealing with Immigration but this my dear, was a really bad mistake. I really think since you have come this far, you may feel that it's worth a shot to just send what you have and wish for the best, but remember your mate will have to deal with this same Issue at the Interview stage of it somehow squeaks by. The Embassy won't be as forgiving. Then you will have wasted additional time, and money. So in my opinion, and this is just my opinion, USCIS has already gave you their stance on the petition, and I think you will be more deveatated to wait additional time for the inevitable. I think you should look at other options, when was your last visit, if you refile  will you need to do another visit before petitioning? 

 

I think I explained before that as US citizens we aren't allowed to file for Spousal benefits such as medical and such for our fiancés, you have already accomplished that. I think you went to far for USCIS, besides my question to you is, what would be the purpose of that, does your Insurance Company provide benefits for your Spouse out of the Country..... For the most part other countries don't even accept American Insurance, at least not mine and I have Blue Cross Blue Shield.

Yeah, this process has gotten out of control.  They need someone to go get them straightened out.  I'm curious what happened to get this far off their timeframe and rfes and everything else going on.
