It's actually listed in the instructions that both petitioner and beneficiary have to have passport photos sent in. Your lawyer definitely should have caught that, especially since you're paying him to do this for you.

Either way, it's an easy fix so I would hurry and get it done so you can get your approval soon.

ROC Filing:

4/21/2021 - Sent ROC Package via FedEx

4/22/2021 - FedEx package delivered and signed

5/11/2021 - Check cashed

5/14/2021 - Received NOA1 via mail (NOA1 date: 5/8/2021)

6/9/2021 -  Biometrics waived - Case updated to Fingerprints taken

Shouldn't need the beneficiary's passport photo since they aren't required to have a passport when process starts (unless you mean the "passport style" photo.

if their NOA1 was June 1st then they are a may filler, as receive date would be in may.

the passport photo is required for BOTH the USC and beneficiary for proper identification and to attach to the petition. It helps when they are doing background checks they need to be able to match the photo with a person that might come up in their database(s) as a possible hit for any alleged offense. Plus, a person facial features changes over time so it is definitely needed and required.

And passport photo is a "passport style" photo. There's no difference.

& @LucyDolly. I want to chip in here about my thoughts on passport renewal during this process. I cross borders a lot with business on my 2-year old passport but the scanners no longer recognise my page as it has a fold in it on the profile page. Ive been told by passport control that the only way I can stop ‘human’ screening is to replace it, but I’m hesitant to do so during this process as I don’t want another passport number on my record which may cause a red flag. So if your passport is still worthy and valid, don’t change it which would create another passport number if you can help it imo.

@June2017UK totally agree :))) If your passport is still in good shape I wouldn't worry about it @LucyDolly

I had over a year left on mine when we filed and in my naive world (before the long wait - that knocked it out of me!), the plan was to renew my passport for the AOS stage when we are married. Ahhhh those good old days! But then everything has taken so long the next ice age is practically upon us, so it was getting a little close to the wire with having 6 months left for me.

This process is so many shades of abnormal - the what if's, the maybes and the down right ARGGGGHHHHHHHHH!! At this stage my sanity levels have been tested so much I fear I may not pass the medical lol - "yes doctor I am afraid I have post traumatic NOA2 stress syndrome"

Wishing you a speedy NOA2 approval, it's going to happen so soon! :)
