My Faye and I are still waiting for our NOA2 after an RFE 60 days ago. We may be in the same boat but not sure. We are day 219 ourselves NOA1 April 10. We have discussed contingencies and if we receive a letter of intent to deny I will cancel the K-1 and marry her in the Philippines, then apply the marriage visa route.

I'm sorry to hear that, hopefully you get your NOA2 soon...What was the RFE about if I may ask?

Sure no problem;

USCIS didn't like the fact that the Judge in my divorce case signed the "Journal Entry of Divorce" instead of the Decree. It was legal for him to do so because it was a default judgement. I had to submit a Certified Divorce Certificate from the state of Kansas in response. That was 62 days ago Sept 13.

I thought only people who never actually met in person would get an intend to deny..

What is the difference between an RFE for needing more proof of the relationship and a notice of intent to deny for the same thing instead of an RFE?

 

Thoughts?

Ok, so you have passed the 2 months already...We(and quite a few other may filers) got an RFE too asking for things that we had provided intitially. This honestly makes me question the adjudication process and how seriously they take it and if it's fair at all. It is insane because most of us opted for K1 because it took a shorter amount of time than IR1, but we might as well have opted for IR1 because K1 is taking just as long with RFE and NVC slowdown...Sort of feels like we were tricked...Waiting isn't even the problem anymore, it's the fact that we have absolutely no communication from uscis besides delayed updates. I wonder if there's something going on at USCIS because May and April petitions seem to take much longer to be approved.

Congrats!! What is the date on your NOA2? I would call the NVC today. I have seen people not get notified via the app or Shoegum's scan and then by the time they get the NOA2 in the mail, the NVC already has their case! So that could be the case with you too, but either way - you are one step closer ^_^. Not sure how it works in Colombia but I am sure you can check your embassy's website for the medical requirements if they don't send them in the mail. Getting the visa before the holiday may be a little hard but not impossible. It all depends on how quickly the NVC gets your petition over to the embassy, how quickly you get the DS 160 and medical exam done and when there is availability for your interview.

I was thinking the same thing.  Notice of intent to deny is much more serious than an RFE.  I didn't realize they give another chance for proof.  I'm confused why it is not just an RFE.  There must be something more to the story.

PHILIPPINES ONLY!!!  CFO (Commission on Filipinos Overseas) INFO - Can't leave home without it!

 

PDOS (Pre-Departure Registration and Orientation Seminar) is for ages 20-59.  Peer Counseling is for 13-19 years of age.

It is required to have the visa in their passport for PDOS and Peer Counseling.

 

GCP (Guidance and Counseling Program) is for K-1 Fiancee and IR/CR-1 spouse ONLY.

I agree. It’s great that we all are able to share our experiences to help each other navigate through the process and understand USCIS a bit better.

 

Hope we hear more on this or someone else who has personal experience with this.

I thought there must have been something seriously lacking in their petition, otherwise they'd send an RFE. Perhaps they didn't provide proof of meeting in person at all?

Just to share you from Japan to US (not all but most places) seems to be free and calling to NVC was free too😊

 

However after waiting for 10 min, I shared my USCIS case number and asked for NVC case number but they only repeatedly tell me that "it will take 6 weeks to send package and on that timing you will know NVC case number" 😭😭😭.

 

I said again I only want new NVC case number first but they said it'll take 6 weeks...I felt like they are just following on the manuals of the call center. FYI - I'm Nov 7th NOA2 and I understand it's early but 6 weeks...!?

 

Do you know are there better call center staffs in NVC?

 

Also I selected #2 from the call options for NVC but what is most appropriate from #1-7 on the calling menu?

Hope I could help you more with the NVC part, however I am still one ot the May 23rd filers - patiently waiting and keep on waiting... ;)

Shoegum has a link in his signature on how to call the NVC - I hope this helps.

Also from the UK... we need to do something pretty wrong in the process to get denied from what I've researched.

Yeah, it does seem like there's more we don't know. Could USCIS losing evidence result in a NOID, though?
