Okay,  small rant before I head to the airport. Waiting would not be such a problem for me if I understood why things are they way they are....I can wait my turn, but I don't understand how they process K1 visas as I see many "skipped" over, later dates approved. Honestly, I would not mind if I just understood why...do I have a denial? Are they waiting for background checks? Did they lose my paperwork? Anyway, even if I have no control over what they do there at the USCIS, I would like to understand it. Even reading the post from an ex-adjudicator did not really help me truly understand. Having no control is bad enough but not understanding is even worse...okay, done with rant. Good luck today everyone and I will be keeping an eye on all of you from Manila, Philippines...peace, love, and rock n roll. Let it rain NOA2's for all of us.....oh yeah, the USCIS gets Friday off...Veterans Day Observation....some may work but it is a Federal Holiday.

Hoping this wait is over for you very soon. Have a great time with your special person. :)

Don't worry. Our May 15th petition was approved after many dates ahead of us (I think May 23 was starting to be approved before we heard anything). It looks like this has been the case for the vast majority of us. Very typical.

Thank you for the encouragement. This is very difficult.

SO EXCITED!!! We just received our NOA2 today in the mail, after 175 days we are finally moving forward! Its been a long haul but the longest part is over, I hope the rest of you get yours soon! Just a quick question, our lawyer says we shouldn't call the NVC to get our number because that wont speed up our case but I constantly hear you guys saying the opposite so what should we do in respect to that?

Did it show on scans or just mail?

Give it 2 weeks then you can call NVC to see if they have your case and see if they have case# and invoice# for you, once you get those you are good to go for next step.

If you don't mind me asking, what are the circumstances of how you and your fiancé met or were there already concerns or circumstances that occurred prior to you sending in your petition?

Kinda would help to know this so that people can provide some insight, although, you will have to wait for the notice to come in mail to see what USCIS rendered as a decision. I apologize in advance if it's anything negative.

ROC Filing:

4/21/2021 - Sent ROC Package via FedEx

4/22/2021 - FedEx package delivered and signed

5/11/2021 - Check cashed

5/14/2021 - Received NOA1 via mail (NOA1 date: 5/8/2021)

6/9/2021 -  Biometrics waived - Case updated to Fingerprints taken

I am Sorry to hear that, I believe you mentioned you two did not actually meet in person. This type of message is normally NOID (Notice of intent to deny) and I believe they give you 30 days with that notice to provide proof against whatever circumstance they made their decision on. It may be based on question 53 if you selected No  or N/A

On the I-129F what did you write down for question 53 and 54 on page 8?

I'm not sure but this could be related to the fact that you stated before... that you have not met in person... just a guess...

My guess too.  If haven't met, it's a really big requirement by them.  Even to justify religion for not meeting is pretty tough from what I've heard.

He said earlier in the thread that he and his fiance have never met in person. Everytime she was to visit she canceled due to her anemia or "that time of the month". I think folks already advised him to have his fiance visit him immediately or they most likely would get denied and lose the money they have invested in filing the application. I'm sorry to be the bearer of bad news but one of the stipulations for K1 is that couple have to had met in person at some time within the past 2 years. Hopefully they can meet asap and send proof to save the petition.

Oh...thanks for the info.

Welp...that would pretty much explain the NOID.

Hi folks,

Not sure if this has been posted here yet, but we just found this on the March filers forum.  This could explain the delays.

Hang in there!

I found this a couple of days ago. It was posted earlier in the May filers forum in August, but a lot of us have joined since then! This info made my fiancé and I feel a little better, because at least it was a reason for the slow down - and a humanitarian one.

"Hi All,

Not sure if this info has been shared already but just spoke with a family friend who works at the CSC in Aliso Viejo - he said that they are experiencing MAJOR delays due to K1s being deprioritized in favor of other more urgent immigration cases. He mentioned that a massive caseload of Haitian immigration applications landed on their desks and they've had to pull a lot of the K1 case reviewers onto the job - apparently, the Temporary Protected Status for those affected by the earthquake got extended so now they are trying to process as many cases as they can so that people don't get deported. Since it's a human rights issue, they've been mandated to prioritze those cases. He said they are so underwater that they've apparently authorized overtime pay for adjudicators for the first time in a long time
