After that, on friday, my fiance emailed the consulate here explaining everything that nvc told us and demanding some action. Today we both received the email from them that our case is there and we can schedule the interview (which i already did two weeks ago lol).

I'm sorry you have no news, I do think there is a error in their system but I think our case wasnt affected, it was just a coincidence, it was more like the consulate lost our case and found now. My status was "ready" for a few days and thats why it makes me think that, but I have been talking to two brazilian girls that are having the exact same issue as you are and they told me today they don't have any new either :(

This is one of my fears. I hope after taking so much time to collect and efficiently lay out everything they don't ask me to send that which I've already sent it. It just doesn't make sense to me how you can send all this stuff and they say nope send again please.

Are you sure it is not your attorney who forgot to include something?

 

If you want something done right – do it yourself.

 

Why did you not reply to the RFE yourself, why did you give all that info to the attorney AGAIN?

Nope they don't mind. I believe a decade or so ago the Medical Center would be the ones to deliver the medical results to the Embassy so extra time was needed. (not 100% on that)

There have been folks having medical same week as interview in Manila

The only real issue is if TB comes up and treatment is required as that will cause a delay. I'm not sure how that information is conveyed to the Embassy unless the embassy is digging through

the medical results just prior to interview.

Sorry to hear about the RFE however at least you know your case is being looked at and not in some black hole. 

Be just as suspicious of your lawyer as you are of USCIS for the disappearing papers. That is from personal experience non-immigration related though.

Occasionally the adjudicator will be looking for one specific requirement and the petitioner has sent a 10 lbs box of stuff (not saying you did that).

They can only spend so much time rooting around before they just send the RFE.

Now is your chance to add other info to support your case. For example if you visited again since the original I-129F was sent you should add those receipts and stamps as well.

 

Did you give the lawyer the letter of intent the first time around?

 

Make copies of everything you send that way if USCIS or USPS loses it at least you have another back up copy.  Make sure it is sent back with delivery confirmation/tracking for your piece of mind.

 

At this point you should have your approval before the end of the month.

Get going on that DS-160 if not already complete.

She recently had her lungs x-rayed because of a cough.  They saw some dark but said it wasn't TB, just an infection.  So there shouldn't be any issues there.  Just keeping my fingers crossed for this year or next year using my vacation early will make for a tough year.
