I finally got my RFE... the thing is that when I submitted my original packaged I attached a document that was signed in front of a public notary in Ecuador to make our "domestic partnership" official so I could add my fiance on my job's medical insurance. It's in lieu of a marriage since same sex marriage is not recognized in Ecuador. 

So the RFE is basically show that we "are single" and able to marry. But I don't know if print outs from the Ecuadorian Civil Registry website along with a letter of explanation will be sufficient or I must get "certified" or "official" paperwork from the civil registry.

I do Paralegal work. My concern with this is that you have a notarized Domestic Partnership, which may in USCIS "handbook" be equivalent to a spouse. It was given Insurance company to prove a "union". I'm not at work today to further research but this may be a huge issue for a Fiancé Visa. This one has me puzzled. I also worked for the Clerks office her in my County. We were never able to provide something stating you were single, one because we only kept records of marriages, and two because we only had records of marriage certificates issued in our county. The only thing available that we could offer was a No Records Statement for an application for a Marriage License or Record of Divorce.

Today is day 160 for us. Wow, I never thought I would be happy to be in the 160's, but I feel it brings me closer and closer to our case being touched. Happy Monday everyone, and may today be saturated with approvals, or at least a response!!!

I got approved in October 27 and I'm currently waiting for my case number. Basically, what you are saying is that I can fill out my DS-160 but choose the option save instead of submit? And I'm supposed to submit it when I get my case number, is that how it goes? Also I'm ready to start on it today, is there anything I need to fill it out? Like uploading a photo or something?

Hey Maria...I replied with the same response to the OP earlier. This is gonna be difficult to prove because in the U.S. "domestic partnerships" are considered legal-binding relationships. Prior to many states jumping on board on recognizing same-sex marriages, "domestic partnerships" were created for the main purpose of allow same-sex relationships being entitled the right to have and/or make legal, medical, financial decisions as a married "straight" couple. For example, God Forbid, something was to happen to the one of the partners in the relationship, the other partner would be able to have "legal" right to make or be consulted with decisions pertaining to their partner's help - just like a married "straight" couple.

 

And even the U.S. court can provide a certified document saying they are not legally married/or in a legal union, the beneficiary may have an issue with this during the interview phase at the Embassy as they still have to prove they are legally able to marry.

 

I also used to be a paralegal (now working in Global Compliance/AML), so what you are saying is correct.

Then I believe you will get notification today or tomorrow!  You are at 173 today!  I can feel it.  Someone is looking at your petition today.  It's 8:00 am in California.  Let the adjudicator get his coffee and get settled.  You are right there.

Yes, I figured as much..... My main focus now is Insurance Defense, so I was thinking back to my days at the court. We never provided anything certified from the court just a basic printout saying something along the lines of "No Records Found", but I really think that Notarized Domestic Partnership may make them "too married" for a Fiancé Visa unfortunately. The lines are to "blurred" so to speak. TBH, it was no reason to include that in the I-129F package. 

 

I would really like to see USCIS stance on this. The "notarized" or "certified" part, in addition to the fact that it was used to obtain spouse's benefits. Leads me to believe that it may be a no-go. I would really be interested in following this, as it would be great information for other same-sex couples.

 

I am curious as to how do you prove you are single, when each court only serves its own jurisdiction?

Me and you both. My received date is May 23rd (NOA1 notice day May 25th). So you know I'm here watching my phone like a HAWK!!!! :D
