You can fill out ds 160 once you get your cas number thats what i did but did not submit yet just saved. Payed the fee online and got receipt number of payment

I would recommend getting certified documentation that shows proof that you two are not legally married or joined in a legal union and able to marry. The thing is, your fiancé might run into the same dilemma when it's time for them to get the certificate of non-impediment which is a certified document stipulating that they are not legally married and this document is needed for the interview at the Embassy.

 

The concern USCIS has is trying to distinguish whether or not a civil union ceremony has taken place for you and partner because in order to add someone on your medical insurance, you have show to proof that the dependent is in some way related to you. Child, parent, spouse and domestic partners are related dependents, otherwise, your job wouldn't have been able to add your partner on your medical insurance. Even though Ecuador doesn't recognize same-sex marriages, "domestic partnerships" are considered legal unions in the U.S. depending how they were performed and if it was done so in a court or under a judicial branch, that could be considered legally-binding.

 

If you are the USC (I assume your are), I would recommend going to your local courthouse in your area and go to the family court location and see if they can provide you a certified documented with court seal that shows that you are not legally married. Explain to them what it is you are looking for and they might able to refer you on your next steps.

Good Morning My May Filers,

 

Happy Monday to you all as we journey into this week which is a short work week due to Friday being a U.S. observed holiday (Veterans' Day is actually Saturday but is being observed on Friday this year).

 

Congratulations to all those that have received their NOA2's and have moved on to the next phase of this process. For the rest of us that are waiting, remember...for every day that has passed is another day closer to your "Golden Ticket".  FYI....be on the look out for this forum being closed soon as we are almost at our limit but do not fret...another May filers forum will be created once this one is closed!

100% for the I-134

125% for the I-864

 

It's recommended to follow the 125% rule though as this is what will be used for the during the Adjustment of Status process later.
