LOL... how I wish this would be the one thing that I could worry about.  I think that you will have your choice of filing married and then it could be filing as married or married filing singly but, since he won't be yet a citizen, he won't be filing taxes... hmmmm... I always use H & R Block; they would probably tell you the answer if you just gave them a call.  :)

lol yup CPA can answer better but since with K1 you get the SS number right away I think you should be able to file as married filling joint or married filling separately. Would be nice to not have to pay taxes in the single bracket

Can you tell me if the background check has been done?

No sir, your application is going thru the normal process.

Can you see if there are any RFEs?

No sir, there are no problems with your case so far.

Can you tell me if my case has been touched or if an officer is looking at it?

No sir, I can only tell you that it is taking around 6 months for approval so you should hear something soon. No news is good news.

He was very nice but wouldn't give me any more info. Oh well...time for a drink! Ahahaha

Okay, here's another stupid question (I swear I should get a 3 stupid question minimum...ha)

 

So, I'm on the CEAC site and on there they have a sample of the DS-160 form. So of course, I printed it out and start reviewing it.

 

For my fiancé and I situation, he had been approved for a Tourist Visa October 2016, came to visit Thanksgiving week but was denied entry and made to fly back home - tourist visa was cancelled (it's a long, miserable, emotional story - it's actually how I stumbled over the VJ site last year and have been a member since).

 

My question is...on the sample application, I know he's gonna have to answer Yes for having been to the US, having been issued a US Visa and for being refused entry...But there's a question on here that says, "Has anyone ever filed an immigrant petition on your behalf with the USCIS"? Would he be answering yes because I'm filing for him now or is this question posed for a prior person petitioning on his behalf?

 

@LabOz ...since you've done this before, when he clicks yes for the first questions above, does a separate entry populate for him to explain this or no?

 

NEVER MIND ON THIS QUESTION...........I SEE IT ON THE NEXT PAGE!!!!!!

 

I told you I should be allowed at least 3 stupid questions a day...I just wasted one! :huh:

Just to clarify, K1 is a non Immigrant Visa, so you have to say no regarding the i129f petition.

You are correct that the question means has anyone prior to you filed an immigrant petition on his behalf so the answer is no.

That's right I should be asking you this since you just went through this.

 

When I go on the CEAC, they have a sample of the DS-160 which appears to be listed under non-immigrant Visa. So you're saying he should click no for Has anyone ever filed an immigrant petition on your behalf with the USCIS?

 

I'm starting to wonder if I should fill this out for him just to ensure they aren't any mistakes. I can fill this out for him right?
