What country is the foreigner from?

K-1 for same sex has been legal for several years and there have been hundreds of VJ members to successfully enter the US on K-1.

It should not be an issue.

 

 

Ending the Legal Defense of the Defense of Marriage Act (DOMA)

  • In February 2011, President  Obama and Attorney General announced that the Department of Justice would no longer defend the Defense of Marriage Act’s provision defining marriage as only between a man and woman, leading to the Supreme Court’s landmark decisions holding the Act unconstitutional.
  • After the United States v. Windsor decision, in which the Supreme Court struck down Section 3 of the Defense of Marriage Act as unconstitutional, the President instructed the Cabinet to review over 1,000 federal statutes and regulations to ensure the decision was implemented swiftly and smoothly by the federal government to recognize the rights of same-sex couples.
  • The Administration has long advocated for a Constitutional guarantee of marriage equality for same-sex couples—a position the Supreme Court vindicated in its historic decision in Obergefell v. Hodges.
  • In October 2015, after the Supreme Court’s decision in Obergefell v. Hodges, the U.S. Department of the Treasury announced proposed regulationsimplementing the Supreme Court’s same-sex marriage decision for federal tax purposes to ensure all individuals would be treated equally under the law.
  • After the Supreme Court issued a decision in Obergerfell v. Hodges, the Social Security Administration (SSA) began to recognize all valid same-sex marriages for purposes of determining entitlement to Social Security benefits or eligibility for Supplemental Security Income. SSA continues to work closely with the LGBT advocacy community to conduct outreach to ensure that same-sex couples are aware of how same-sex marriage affects benefits.

No problem. I beleive there is a member here something like Ben & Ziam I can't even recall off hand but he is very knowledgeable in this aspect. Try and look him up... Good luck

Hey friend ,don't feel like that ,I have a forum talking about same sex ,im in the same sex process too ,I received my Noa1 may 16th, I had some good answer in my forum, they told me I have nothing to worry .  They didn't have any problems ,please don't stress that way , we have the same right ,for being same sex it's not a challenge . Be patient soon you will have good new !

So yeah.. it's the end of one more week and not many approvals lol hopefully next week will be better!

Hi Everyone. My fiancee filed the K1 and was received by USCIS May 8. I"m presently staying in Africa and the US Embassy we put to have my interview is here in Africa. I will be leaving africa by November but my K1 application haven't came out yet. Is it possible to change address and schedule my interview in the Philippines instead.

Hm, I have no clue. Never heard of a case like yours, but I'm sure it happened to someone. Try to look it up here on VJ. I think that maybe you will have to come back for the interview in Africa, since that was the place you said you were going to take it in the paperwork you filed.

 

I have moved after we filed, and was informed that I should contact my embassy to let them know it once our process come to Brazil, but since I moved to another apt in the same city, it's a whole different situation. Maybe you should have your fiance call USCIS to have more reliable information about it.

 

and maybe you wont need it, if you stay til late november there it's possible that you can have your interview before it.

As far as I read in the forum you can change the Embassy before NOA2, just write to CSC to update your information. And when it is time to schedule your interview just take in mind you have to choose a date when you will be there.

Consulate received - November 28th Packet 3 sent - December 18th; Packet 4 received - December 22nd; Medical exam - January 3rd 2018; Interview -January 17th 2018 APPROVED

Visa issued - January 18th Visa delivered - January 19th POE - January 28th

 

AOS+EAD+AP

Package sent Feb 23rd 2018, Delivered Feb 26th 2018, NOA1 - text and email confirmations March 8th 2018, NOA1 - hard copies received March 12th 2018

Biometrics appointement - March 30th 2018 (requests received March 16th), 2nd Biometrics appointment for EAD for one of my K2s - April 16 2018

New card is being prepared for I-765 - August 13 2018 (online status), Card is mailed - August 16 2018 (online status), Received approvals for i-130 and i-765, also letter for interview - August 17 2018, Status updated to USPS received your Card - August 17 2018, EAD/AP combo cards received in mailbox - August 18 2018,

SSN cards(K1+K2) received in mailbox August 20 2018

Interview - August 29 2018 Green card for me K1 received September 7th 2018, K2s received 2 weeks later

Please dont feel that way!  There are many same sex couples here and as far as I have seen, they are treated the same as the heterosexual couples.  Just follow all of the instructions like we all do.  Love is love and the CO should simply abide by the law of the land.  We are all the same in the eyes of USCIS.  We all are nothing to them!!!  LOL

 

Just keep the eye on the ball and soon we will all be with our loved ones.

PHILIPPINES ONLY!!!  CFO (Commission on Filipinos Overseas) INFO - Can't leave home without it!

 

PDOS (Pre-Departure Registration and Orientation Seminar) is for ages 20-59.  Peer Counseling is for 13-19 years of age.

It is required to have the visa in their passport for PDOS and Peer Counseling.

 

GCP (Guidance and Counseling Program) is for K-1 Fiancee and IR/CR-1 spouse ONLY.

May is really not looking good right now.

There are over 90 unapproved VJ members with April 18th to April 30th who still have not received their NOA 2.

Yesterday 9/14 there were 4 approved cases for April filers.

CSC is averaging about 5 VJ member approvals per day.

Just to clear out the last half of April at 5 per day it will take 18 WORK days

Plus there are many April filers prior to the 18th who have not received NOA 2.

 

Something needs to change as CSC or they will be looking at 12 month approvals for filers next year.

Hopefully we get some action for today but so far the app has been church mouse quiet.
