Hello VJ members, my friend told my to get your help.. She is married to non USC who came here last Year on K1 visa.. They had a baby 2 months ago.. They applied to AOS and got an interview last november, but they had a fight and they postpond it, he changed since he started working , and he is treating her so bad, they live in her own house but he is not paying any pills or helping her with the baby stuff, he tells her she has more than enough money , she told him we need to get a divorce, but he is refusing because he likes to live here in the US.. So she hired a lawyer for a divorce,, but she is scared that he will run away and he will not be deported , Or he will get asylem or refuge status and stay here ..she is afraid he will take the child .. Since they postpond his AOS status they did not get another interview date, but he told his friends that he had a lawyer to help him moving his case..

Well the only why he can adjust without her is through WAWA so your friend needs to protect herself. Meaning don't live at the same place so she won't get the police called on her.

 

but she is scared that he will run away and he will not be deported , Or he will get asylem or refuge status and stay here

 

Sorry but that is not up to her at all she should move on and focus on herself and the baby.

You do not need to know the address to file for divorce.

She said he should sign the papers that her lawyer prepared for divorce.. Or at least sign that he recived them.. But he told his friends that she can not divorce him she just saying that , because she can not lose her money for him after the divorce, they live in 50-50 state.. But she dose not care, She is fed up with him

He married her last year, the best he can do is get 50/50 of whatever is left over from last year.  Anything that was hers before the marriage remains hers only.  It's only earnings earned during the marriage less expenses that still remains would be 50/50.  Can't imagine there is much left after baby expenses.
