Hi, everyone, 

 

I received an RFIE that says the following; 

 

  • Form I-864 Affidavit of support was submitted; however page 3, part 4 of the petitioner/sponsor's form I-864 list someone other than the petitioner/sponsor or Page 3 part 4 is blank. 

Submit a completed and signed Form I-864, (revision date of 07/02/2015), for the petitioner/sponsor listed on Form -130 or form I- 129F. Even if a joint sponsor will be used, the petitioner/sponsor must submit Form I-864. Also provide copies of the petitioner/sponsor's most recent Federal income tax returns and all supporting tax documents (W-2s, 1099s, Form 2555, and tax schedules) 

 

I'm sure I completed with my husband name and address and didn't leave part 4 blank (I only left blank part 4 from 4a-4h because I previously ticked on the box that says that the physical address is the same as the mailing address). Or should I have completed it as well???

 

  • Form I-864 Affidavit of Support was submitted from a joint sponsor; however, the names listed on page 1 and page 3 are not the same. 

Submit a completed and signed Form I-864, (revision date of 07/02/2015), from a joint sponsor,  Also provide copies of the most recent Federal income tax returns and all supporting tax documents (W-2s, 1099s, Form 2555, and tax schedules), and evidence of their status as a United States citizen, United States national, or Lawful Permanent.

 

We didn't submit a joint sponsor because we don't need it. I wonder is this is  because they say that "page 3 part 4 was wrong or blank" that also caused this problem????

 

Help please, I called USCIS but they don't give solutions or advice or reference to any specific problems.

yes, and they were all properly completed, or is it that they need more supporting documents for this affidavit?? they should have specified that... don't you think so? , what I sent was: 

·         Copy of my husband birth certification (US)

·         Copy of his passport Bio page

·         W2 (years: 2016, 2015 and 2014)

·         Certificate of Employment

·         Recent pay stubs

 

same kind of docs we sent when we filed petition I-129F,  but these were updated of course. 

I don't understand, :(

You listed his W-2s.  How about his complete tax return?

 

Your usage of "I'm sure I completed . . ." suggests that you are are trying to recall from memory rather than looking at copies of your submission.  That's why I asked if you are looking at your copies.

 

It's your job or your lawyer's job to send in a complete I-864 with the proper supporting documents.  Everyone's case is different, so USCIS does not know what people have.  To them - the I-864 submission is either satisfactory or not.  They are not your lawyers and will not get into specifics.  They are not going to say you are missing this and that since it's not their job.  It's not USCIS's responsibility to specify for a particular supporting document.

W2's don't suffice alone for the affidavit of support. Go here and print his complete tax return transcript to add to the RFE response.

Yes,  I saved a copy of the completed form in my PC, like the other forms as well, not physical one though. 

We didnt send the "return transcript" ( we didnt have them when we filed ) but we have them now (2014, 15 & 16)

There's your problem.  You didn't send in his tax return as required.

That's the problem indeed. Tax return will show his gross income and that is what they want to see.

my husband odered the one called" Tax return transcript" by mail,  for 2014, 2015, 2016, is that the one they need?

It shows income,  taxes etc, (5 pages about ) per year

There is an option online too, you can print it out within a few minutes and no need to wait 5-10 days.

My husband just asked a lawyer and he said that we need a "complete tax return" and that it takes 30 days to get them ..what??? 

I'm reading and some filers sent form 1040 which can be completed online, do I have to complete that one as well per each year??

 or are these tax return transcripts  all what we need,

are they like "Complete tax returns"?

are they what the RFIE asks for: "Most recent Federal Income tax returns"? 

Oh no I think I missed important docs :-( , different names for the same docs?

You need tax return transcripts, like in the link I provided. Tax return transcript are complete tax returns.

IRS tax transcript = complete tax return = federal income tax return.  All the same thing.
