/UM,

Same as the disadvantage of applying for EA before AOS for a K1 - the EA is valid for the duration of the allowed stay in the USA as indicated on the I-94.

Yodrak

Yodrak,

Can you explain further what is the benefit of applying for Employment Auth before AOS for a K3?

.....

Thanks!

/UM

The answer seems a bit cryptic. A K3 can apply for EAD at the same time as AOS or do so before. EAD approval takes about three months, where AOS often takes longer, sometimes much longer. Some, like me, choose to delay filing AOS for various reasons but file EAD ASAP for various reasons. The EAD will be valid until the I-551 expires, two years after the date of first entry. If there is not hurry to go to work, you can do without EAD altogether and just wait for the green card.

Or do so after.
