can I use expired passport to prove Sponsrs citizenship?

My cosponsor lost his birth certificate and that takes way too long to make. He has his expired US Passport tho. I mean even if its expired it should stil prove hes us citizen righr?

on the i864 institutions it does not say it needs to be an unexpired passport but they usually like to see current photo ids. you can try and if you get an rfe it is an easy fix. also might suggest the sponsor either renew it or get a copy of the birth certificate just in case.

Yeah when you said it would take too long I was curious as to why.

You can do overnight or two night shipping through Vital Check. But yeah it can run you upwards of 80$ for it.

Im asking about that because im in the middle of the DCF process. I have a copy of my cosponsors Expired passport and he lost his us birth certf long ago.  And im trying to move with my spouse asap. I would have paid for my sponsors birth ceetf if they ask for that at the interview.

I lost my birth cert twice in the K-1 to AOS process LOL. I used Vital Check and paid for the 2 day shipping. So if you can wait 2-4 days, you can get him to go ahead and order it, but he will need it. Even if they send an RFE, it will just ask for it, and if he doesn't provide it then, that's when you can end up with a denial.

Timeline

As others have mentioned, best to have current documents. 

A current passport or the birth certificate is a must.

 

On the other hand, luck may favour you and maybe the interviewing officer may miss the fact that the passport is expired but then should one take the risk. No doubt, the worst that can happen is that you will be asked through the medium of a RFE to get an updated document but that would only cause further delay. You are given a period to reply to the RFE but after you replied, the consulate is not obliged to look into your case immediately and hence there is even further delay.

 

All in all, its a pretty simple process and only a few documents are asked for and hence it is best just to put the same together before going for the interview (along with time delay, one may end up spending money too..hence perhaps better to spend on the paperwork than waste on unnecessary expenses later on)
