Hi all,

 

I recently moved to the US with my K1 visa and everything is going great apart from one small problem; getting a florida drivers licence. I went into the local DMV the day after I moved and my local office processed my application and let me sit the written test which I then passed. No problems there. I went back to the desk and they told me the earliest they could do a practical test was 3 weeks, which didn't work for me as my fiancee and I were driving up to New York 4 days later, and staying for at least a few months. So we went to the county across which does walk in appointments, but they told me I couldn't sit the test as one of the requirements of the K1 was to be married before they could give me the licence. They also told me that i'd have to come back and get the licence with no fewer than 61 days left on my k1 visa.

 

So my questions are as follows:

 

Do I have to be married before I can get my licence or is this guy incorrect?

Will I be able to get my licence if have fewer than 61 days on my visa?

Generally I think I have seen most people be married first, then apply; but not entirely sure if that is the case for Florida..

 

Same goes for the 61 days or fewer thing... most people I have seen if they get a driver's license while on their I-94 through the K-1, the license expires at the expiration of the I-94, then they have to go back to get a new/renewed license showing they applied for AOS.

02/03/2017 - Married

06/01/2017 - EAD/AP Combo Card Received in mail

12/06/2017 - I-485 Approved

12/14/2017 - Green Card Received in mail - No Interview

So if most people get a new/renewed licence after applying for AOS, does that mean I can go and get my licence for the first time after I have applied for AOS? This will be well within the 90 days of the I-94 but less than 61 days?

They will most likely issue you a temporary drivers license based on your I-94 that expires once your I-94 does too (90 days from the day you entered the US on the K-1).

I tried getting a drivers license through my I-797 NOA1 from AOS. Honestly, with all the hassle that came with it, I don't even recommend it either. Verifying me was taking almost two months for them.

I'd say, wait for you employment authorization card and apply for a license. Easy peasy and you walk out with a valid drivers license.

hmm, fair enough. The reason for the rush is that currently its costing my future In-Laws a lot to have me on the insurance for the car they are giving to me, so time is really of the essence on this one. I'm planning to fly back to FL for a couple of days to get it done but I want to be 100% sure I'll be able to take the test so I don't have a wasted trip

In this case you can not be 100% sure. It all depends on E-Verify (how long it takes to verify you) and the DMV. You can try to get a temporary license through your I-94 and then try to renew if with your NOA1 from AOS that is proof you are granted a legal stay like Ben said above.

From my experience:

DL #1 - as soon as i received my SS# and my DL #1 had the same expiration date as my I-94.

DL#2 - when I received EAD. We filed AOS asap, so the gap i didn't have a DL was about 3 weeks. DL was valid for 1 year, as my EAD.

DL #3 - with EAD renewal (my AOS took 15 months).

DL#4 (finally) - when I got my green card. But here I was blessed and my DL was issued for 6 years regardless the expiration date on the green card.
