GM May filers. Feeling like it's time to put in SR for my EAD ('case was received' date May 24th so I'm over 75 days).

 

2 questions: I had a request for initial information for my I-485. Does anyone know if that delays the EAD? I've seen on the website about how the days are calculated, and the clock stops and then starts again when they receive my evidence. But if the RFE was only for the I-485 (proof of marriage - all sent and accepted), would that stop the clock on the EAD as well?

 

Second question is, has anyone found the easiest, quickest way of getting to speak to someone about raising SR when you call the 1-800 375-5283 number? I keep going round in circles and getting "you can get answers to most questions on our website or by chatting on line to 'EMMA'". How do I get to speak to a person so I can raise my SR? Any assistance gratefully received! I have also sent in an e-request just now. 

 

Lastly, I know there are some Baltimore office filers out there. I just noticed they have updated their I-485 case processing to June 30 and it shows processing cases as of July 16, 2016. This is depressing but it's moved on from the May 31 update by a couple of months. Hang in there!

I had a request for initial evidence on I-485 as well and from what I've gleaned from VJ and other sites, I think it does stop the clock for the EAD, unfortunately. :( But there are cases of people saying it didn't seem to stop the clock for them, so there is hope!

 

Its super annoying, as it took them 2 months to even get the RFE to us - almost seems as if they did it to stall...

Yup. 

Dial the 1800 number. Press 1 for English. Press 2 for case status. Press 1 to dial your receipt number. Dial your receipt number using your keypad. Press 1 to confirm your receipt number is correct. Press 3 to report a problem with your case. And this will put you in touch with an agent.

Ah, great, thanks! For some reason I couldn't get there! 

 

When it asks for receipt number, is that the MSC number? If so, do I type in the corresponding keys for the letters MSC?

Yup. Dial the full thing, so MSC would translate to 672etc

I've sent in an e-request with a response date of 5 Sept. My 90 days would have been up on 22 August if there had been no pause, so I guess I'll find out in a week or so. So I guess with the RFE, the clock stops on the date they raise it, and starts again when they update to say they are working on your case again. Mine took about 7 days to turn around so didn't stop for that long.

It appears as though you are right :-( I just checked the Tip Sheet for EAD. It says the clock will reset on the date they receive the information they need.

 

"To determine whether your case has been pending more than 75 days, you must consider the following:

  • If USCIS issues a request for initial evidence, the 90-day regulatory timeframe will start over from the date USCIS receives the initial evidence.
    • For example, if your case is pending 60 days when USCIS issues a request for initial evidence, and you respond 30 days later, the “clock” will be reset to Day 1 on the date USCIS receives the evidence."

I have seen other posters say that the request had no impact on their EAD, only the I-485. I guess I will find out either next week when my initial 90 days passes, or 5 Sept when (if!) I get my response to my SR. I will update everyone on here.

 

For info, the case status on my EAD never changed the whole time that they were seeking initial evidence, only my I-485 status changed to show they were awaiting initial evidence. For my I-485 I've been 'ready to be scheduled for interview' since Jun 29. In fact my EAD status has been the same ever since it was created ('case was received 24 May')

Hey All

 

So today I'm on 91 days and I called a tier 2 officer this morning to ask why I have not recieved my EAD, well as usual they are not sure but to add to the pain he could not put in a second service request as the first one I did on day 75 is still pending which I wish I had not done as they apparently mainly look at the ones over 90 days, so I then have to wait till the 21st to send an email to this Service request department. I guess the only good news is that he said my case is ready to be scheduled for an interview but it does not show up online so I have no idea what to go on.

 

With regards to normal RFE I had the first tier 2 officer tell me about 2 weeks ago it didn't affect my EAD but then today I got told it would have so again do they even know what's going on.

 

if anyone has advice for the EAD that would be great.

I have amazing news!!! 

So card had been approved and going to be sent out tomorrow.

 

I called this morning, spoke with tier one officer they put in another service request then transferred me to tier 2 officer and they say the card was just approved this morning. 

Let me put my full process:

april 24th sent packet 

may 3rd  package recieved (although I didn't get the letter until end of may)

biometrics (6-15-17)

 

Then I did three SR 

Then called congressman and annoyed the sh** out of them.

Then did a expedite. . .  About two weeks maybe less than two weeks the expedite was pulled Friday(8-11-17)and approved Monday (8-14-17) 

 

This has been the most exhausting process Bc of the lack of control but reading everything on this chat has helped so much, late nights stressing, early morning panic attacks while checking  my low bank account, now I can get my damn brunches back, YSL HANDBAGS and monthly massages. Praise Jesus! But really only but God, got me through this process. . . 

 

 

Status still has not changed online 

111 days since sent package

104 days since they received packaged
