I know right, I thought maybe they made a mistake , I have been checking my status every hour since then to see if they would remove the update, but hey its the 5th day after the update and its still there...USCIS is unpredictable :D

Awesome news!!!  Congrats Asakelove!!!

Citizenship process complete!  First a J1 work/travel Visa visitor from Philippines to Texas where we met each other, then back to Philippines.  Ultimately, immigrated here via a K1 Marriage-based petition in 2016, AOS started in 2017, completed in 2018, ROC started/completed in 2020, N-400/Citzenship granted in 2022 - timeline link below:

Ok so called the help desk.... no help at all! Agent was like, we can give you generic information without the beneficiary being on the phone as well. He gave me a speech about generic info, probono lawyers who could look it over, schedule an info pass appointment and they could help but nothing else... Told him I could call my wife and get her on the phone for us and mentioned it was the same thing he would tell. He could see the latter sent to us but not any of the actual details. Hate that, also said there'd be no way to pass a reply to the adjudicator.

 

However looking through the 864 directions I think I see the issue "If you provide a photocopy of your Federal individual income tax returns, you must include a copy of each and every Form W-2 and Form 1099 that relates to your returns. Do not include copies of these forms if you provide an IRS transcript of your Federal individual income tax returns rather than a photocopy unless you filed a joint income tax return with your spouse and are qualifying using only your income."

 

My tax transcripts include my ex-wife which I am assuming is my issue because I guess they don't want to include her income on verifying my sponsorship of my new wife. ;) If it's anything else, I'm at a loss. Went ahead and included my 2016 W2 a 2016 1099-Misc form from rental income, 4.5 months of pay stubs from the old job, 2.5 months of pay stubs from the new job, the offer letter again so hoping thats more than enough to show I meet the poverty guidelines.

 

Question on this - wife is interviewing today, so if we sent it overnight - do I need to wait for a status change online to request an expedite on a job offer, or based on delivery receipt of the RFE package(deliveryed on 6/20 by noon) can we request an expedite once she has offer letter in hand? Also after speaking with the USCIS hotline - how do you goto a tier 2? You just call and say I need to expedite and then they transfer you or you have to ask and beg?

They refused to expedite for me until USCIS confirmed receipt of the response to their RFE. I believe it took them 3 days after delivery to confirm receipt. You can still try your luck.

 

I got transferred to tier 2 a few times by telling them that I had touches on my account stating my expedite was "completed" but not hearing an actual response via email. Anything above their pay grade, they transfer you because I never once asked to be transferred to tier 2. If the situation is complicated enough, they seem to give in and move you on up. No clue :wacko:

Sorry, I though I replied to this. I don't think it's right to discriminate based on type of job. HOWEVER, the decision to expedite is discretionary and depends on a lot of factors. For instance, an offer for a job requiring certain skills and qualifications might not come around as often or as easily as a job at a fast food restaurant, for instance. For that reason, it seems as if USCIS has less reason to expedite a person who has been offered a job serving Chipotle over a person who has been offered a job performing heart surgery over at Hopkins. I'm not sure, this just seems to make sense.

Ok thanks again! Just gonna wait until the status online updates, I'll check for delivery tomorrow and then start checking around Thursday. Praying no more RFE's, like I would hope they checked everything and would send it, not just thumbed through until they found the first thing they could stop it for.

I might be wrong, but I think you can request expedite with completed biometrics and job offer letter in hand.  I recommend that the letter contain a start date (with a caveat of "or upon USCIS authorization to accept employment within a reasonable time) and all terms of compensation (salary, medical, benefits, etc.)  I don't think that outstanding RFEs will impact expediting, my logic is that they are authorizing the immigrant to work in advance of successful AOS so what should it matter what's happening with other things since a final decision is still pending.  As long as biometrics are done and job offer is in hand I say request expedite, what's the worse that can happen?  I requested twice and still had my EAD approved very quickly.

 

Don't know how to get to tier 2, never needed it.

 

Your affidavit of support sounds muddy, all I can suggest is go back to the very beginning, compare what you provided to the directions looking for anything that might not completely align with that was asked for and try to simplify as much as you can.  Won't be easy going back and forth by mail, but as long as you are confident that your qualifying household income is above the threshold everything will work out!

Yeah, I tried this but was informed by Tier 2 and Infopass that once an RFE is issued, review of ANY PORTION of your application will be suspended. I received an RFE for my I-130 and they refused to continue processing my expedite even though I had faxed all my documents regarding why I needed the expedite in the first place. It was not until USCIS saw that they had received the response to the RFE that they allowed to renew my SR to expedite.

Gotcha. I get the logic both ways, if the RFE is in process not allowing it(since they aren't sure how far the application will get) vs allowing it since they are already by passing the interview and final decision most of the time anyway. She just had her interview today, issue is now HR is trying to work around background check for job offer. She worked in the US before about 6 years ago, so the HR lady told her to give her the social from then. Think we will just mention like before - if we can get an offer letter stating contingent upon USCIS approval and background check with a start date. How most offers are worded anyway, pending background check.

 

Yea I totally get the affidavit of support issue now. I think they should word their document a little better because in some areas it makes it seem like the tax transcript is king and is all needed. Further down, it does say the issue about tax transcript requiring W2 if you only want your income considered so my tax transcript includes my ex-wife income and doesn't separate it out. 

 

My big thing with this is - I've sent you an offer letter from my current position, a pay stub and my tax transcripts so in reality, you know how much I make. Even if you don't trust my offer letter, you have my pay stub from my employer.  I sent what was requested in the RFE showing all the data as well,  has anyone ever hit that even though there income was double or triple the required income they still didnt let you be a sponsor?

 

*rant alert* The required income for 4 people is 31k, no one living in Dallas Fort Worth area is generally making 31k over the age of 30. That's just me ranting and bitching about our property tax... but oh well. At this point, if what I sen't isnt sufficient I guess we will go by a lawyer as I can't think of anything else to show them to show my income.  It's like W2 covers the income verification solo for myself for 2016 and then the paychecks for all of 2017 cover income for this year so its like what else do you need?

I think there is a difference between an office transcript and copy of your return. Transcript typically does not require W2s where returns do. Either way, is it clear in what you've sent which income in past years is yours and which is your ex's?
