I wrote a letter explaining my financial situation. I included my current salary and my husband's. I detailed rent payment and how my husband and I allocate costs, student loan payments, health insurance information, and explained I would be terminated. I attached copies of cashed checks for the last 4 months for rent (paid in my name), copies of my student loan statements, copy of my health insurance plan (tied to my employment), and my initial hiring letter stating my firm needs proof of work authorization. I hope this is helpful. Good luck!

BTW, if you expedite thru USCIS customer care, an officer will email you within 24-48 hours requesting evidence of why your case should be expedited. You can then fax over all the info. It took me less than one hour to type a quick letter and print everything I needed. If you go thru your congressman, you can send everything to him. I did both. A guy who was previously employed at USCIS said congressmen expedites got top priority so consider that too.

I received an email that they received the response to the RFE today. The RFE was for my sponsor/dad's letter of employment and paystubs... phew..

 

Application Type: I485, APPLICATION TO REGISTER PERMANENT RESIDENCE OR TO ADJUST STATUS

On June 16, 2017, we received your response to our Request for Evidence for your Form I485, APPLICATION TO REGISTER PERMANENT RESIDENCE OR TO ADJUST STATUS, Receipt Number MS-------------. Our National Benefits Center office will begin working on your case again. We will mail you a decision or notify you if we need something from you. If you move, go to www.uscis.gov/addresschange to give us your new mailing address.

Closest comparable is a job offer, I had been working under a TN1 that expired and was unable to extend. I've been out of work for nearly three months now. I included a letter from my employer detailing there desire to resume my employment upon authorization with my AOS package. When I requested expedite I informed the USCIS agent that the letter was present in my 765 application. My EAD was approved 3 days after expedite request.

So I got my RFE and its related to the 864...3 boxes on it -

 

"The peitioner/Sponsor list their current income as an amount to be considered however no evidence has been submitted as proof of current income."

 

"Submit all support tax documentation for the most recent year"

 

"Based on documents submitted with the 864 the income did not meet the guidelines for the household size"

 

 

Background - married for the last 3 years, so filed married filing jointly with ex-wife. Also switched jobs about a week before I sent in the AOS so I included offer letter and latest paycheck from new job.

 

I sent in 3 past years tax transcripts from the IRS website, so they have this information...

I also sent in my offer letter showing my salary for the new job, and most recent pay stub(which was only for 1/2 the pay cycle, get paid twice a month.) As I only have had 1 full pay check + this pay check now....

My household size is 4(2 kids, me and her....) so I see the poverty guideline as 30,750 right? Or am I reading this wrong?

 

I just feel like they didn't even look through the packet as all this information was included! Frustrated since now this is a week at least hold up..... Wanting to call Monday and escalate or something... Im well over the income limits unless they are doing some funny rounding or something even at the new job still double the income requirements and even shown in the offer letter and verified in the first pay check ....

Poverty guideline appears right.  I wonder if the job offer letter is introducing some confusion on their end.  The way I understand it, the beneficiary's income can be used to demonstrate adequate support if that income will come from the same source.  If this is where the problem is, providing additional pay stubs with a letter assuring them that the same beneficiary income will be present before and after AOS.

 

Perhaps a call on Monday requesting clarification on what the actual problem is might clear things up and give you guidance on what you need to provide them.

Just an update: I have received all 3 NOAs about a week ago, and requested to expedite the EAD based on job offer (start date was June 15th), and it was refused since I haven't done my biometrics yet (as expected). They said I should make another service request after doing the biometrics.

 

I got my appointment letter yesterday, for June 22nd, but I am planning to attempt a walk-in tomorrow morning (Oakland CA office).

 

Then I plan to request to expedite again with the same job offer, but the start date on it (June 15th) has passed obviously... So what should I do in this case? Will they still approve it even if the start date is a few days/week past? Should I alter (or request my employer to alter) the start date on the offer letter for June 30th?

 

To be honest, I actually took the job and started working (my own reasons please don't judge me based on this fact).

 

Can anyone share some advice regarding my situation?

Starting work prior to having an approved EAD in hand introduces risk to you and the employer that some employers are willing to take. The problem is that you have to produce proof that you are authorized to work within 3 days of starting.  As for the letter, I think if it states "June 15 or as soon as authorized within a reasonable time" will work as it shows desire to hire you and implies that they will not wait indefinitely demonstrating severe financial loss.

 

I  suggest asking about the risks of working in advance of EAD in a more widely viewed thread.

Ok yea was thinking the job offer. I would be fine with them requesting it at the interview or saying make sure you bring it cause right now, I can still only send 1 pay stub to them. Ill let everyone else know what they say on Monday. Hoping to hear feedback.
