I've been reading through the postings, but I didn't see anything about having to file an Affidavit of Support (I-864) along with the I-485 for a K-1 visa AOS.  Do I need to file this, along with the tax returns, with the I-485?  And the G-325A must also be included in the I-485 packet?

Sorry for the dumb questions, but reading through the postings and the USICS I-485 instructions is sort of confusing as to what exactly is needed.  I don't want to leave anything out of the packet and delay the processing.

Yes yes, you need to send in the Affidavit of Support! I sent mine in with the application but did not send the last two year tax returns by my husband (because he did not file them - I've told him off for this). I made him file them late and we assume USCIS will send us an RFE asking for the last 2 returns. By then, I hope the IRS would have processed the returns so we can request the transcript.

 

And yes, you need the G-325A also. If you do not send these things in now, they will ask you for it later and your application processing will be delayed. I'm not aware of anyone's application being rejected for failure to submit those documents but USCIS has said that this is a risk.

 

This is what USCIS has on the website:

  • Copy of approved Form I-130 or Form I-797, Notice of Action, if Form I-130 is pending (if K-3 or K-4)
  • Copies of any other approved application or waiver you have had in relation with your application for K status (Approved Form I-129F, Form I-601, Application for Waiver of Excludability, etc.)
  • Applicable filing fees

Thank you SO much for your response.  I will complete the needed forms and documentation so as not to delay processing.  And good for you getting on to your husband for his tax filings....lol!

Hi, so unfortunately, I am also sailing in the same boat. Send all the papers on May 1st. Not sure what happened. ..till now no news.  Tried to contact the attorney. Was adviced to wait...waiting is hard. Each day is getting miserable. I thought I was the only one but I feel all are not fortunate. Dont worry, we all will get the NOAs soon. Just keep the positive spirit.

I tried a walk in for my biometrics today. I lined up from 8am and based on the receptionist's attitude, I just knew I was going to get sent away. Long story short, she told me to take a seat until they call walk-ins after noon. I came back to work and will be going back at noon so fingers crossed. I could wait until my real biometrics appt next week, but I really need my EAD and I have a sick feeling that one week will make all the difference :(

So sorry to hear you had this experience!  We're about to try for a walk-in right now...it's an hour's drive each way, so fingers crossed for us!

Just be patient, don't worry. honestly it took us a solid month. Then received the official Noa in mail about a week later and still waiting on the biometrics. If you tracked it and it has arrived they are just taking their time to process it.

Hi everyone! So here's the update(i was told to call back if it gets passed 30 days since NOA1 and still no bio appointment letter).  I called USCIS this morning, i got a confirmation number for my biometrics letter appointment and I should receive it in 15 days or so.  I also got to ask where my docs now and if my case gets transferred or not. Basically it all boils down to the load of cases at NBC, the field offices and the person who's actually handling your case which we all know that already :D And the most important thing is that, yes, my applications are within the processing time frames...So, the wait continues...

 

So, as of today May 30, my case has been active for 33 days based on the app, but 29 days based on the receipt notice dates.

Who did you talk to? I am on day 29 (since noa1 but they recieved my application apr 26) and the person i spoke to said call back in 2 days. No appointment yet. 😣

I received RFE in the mail today for AOS but kinda confused.

 

Uscis RFE letter (You have submitted secondary evidence and/or a birth affidavit as proof of the applicant birth record. However, the evidence submitted is insufficient.)

 

Please what do i  need to do😌 because  i  submitted copy of my birth certificate for AOS not original and i  used thesame birth certificate for K-1 interview and got approved

You didn't need to send the original. A copy is fine. Is your birth certificate in English?
