Problems with former employer

My oh so lovely former employer still owes me my last paycheque. I've been danced around by my former manager, and 2 HR people so far. They've been given the new address 4 times to date, and somehow my cheque still doesnt make it into the mail. Has anyone experienced this before? Any ideas on what I can do to get my paycheque?

I-129F sent: August 18th, 2006

NOA2: October 2nd, 2006

Packet 3 returned to Mtl: October 26th, 2006.

Medical: January 10th, 2007

Interview: January 23rd, 2007, at 2:30. APPROVED

Entry to the US: Feb 28th, 2007 POE Ivy Lea

Married: March 2nd, 2007

AOS/EAD sent May 4th, 2007

NOA1s for all 3 AOS and my EAD May 14th, dated for May 10th

EAD touched May 28th,29th, 2007, Youngest daughter's AOS touched May 29th, 2007

Biometrics: May 30th, 2007

All cases touched May 31, 2007, June 5th, 2007, August 1st, 2007

All 3 AOS transferred to California July 5th, 2007

EAD Approved July 27th, 2007

Finally movement on my AOS, touched on Feb 22 & 24th

GC May 11 2008, date of april 29th on them.

Hi Amanda-Lise. Sorry to hear about your former employer. Have you spoken to someone directly in payroll? When I quit my job, I talked to the payroll manager directly and they ended up direct depositing my last pay cheque for me instead of getting a cheque.

2007-04-17: Received at Chicago

2007-04-23: NOA1 date (both)

2007-05-10: Biometrics appointment (both - Biometrics review)

2007-06-05: AOS interview letter date

2007-06-13: AOS interview letter received in mail

2007-07-03: EAD card production ordered

2007-07-07: EAD card received! (yay!)

2007-08-23: AOS interview (Documents / Interview review)

2007-08-23: Green card production ordered!!!

2007-08-24: Welcome notice mailed!

2007-08-27: Green card production ordered again... ?

2007-08-28: Welcome notice received!

2007-09-01: Green card received!

Done with USCIS until May 23, 2009!

Is there anyone that you can send as your personal agent to PERSONALLY go to the HR dept and pick up your cheque? Maybe you could send a letter by Registered Mail...they have to physically sign that they received it...and you'd have proof that at least they're getting your letter. Hope it gets worked out soon. :)

Ya, I'd be getting a family member or close friend to pay a visit to your past employer. . . and just to prove what they are there for. . . fax them a signed letter by you with your new address on it, requesting your paycheck that you should have gotten months ago!

April 13/06 NOA1 from NSC

June 1/06 - Moved to CSC

August 12/06 APPROVED - NOA2!!

August 28/06 Left NVC. . . Vancouver Bound!

September 27/06 Interview APPROVED, with visa in hand

October 29/06 Moving Date

December 30/06 Married!!

AOS Journey:

January 16/07 Sent out AOS, EAD, and AP docs

January 23/07 NOA1's for AOS, EAD and AP

February 13/07 Biometrics in Portland, OR

April 7/07 EAD and AP Received

April 24/07 Interview Scheduled . . . and APPROVED, stamp and all!

May 7/07 Greencard is in my hands!

February 17/09 Sent I-751 to CSC

February 18/09 NOA1

March 14/09 Biometrics appt.

April 22/09 Date of Approval!!

June 25/09 Greencard arrives in the mail!

Contact the Labor Relations Board for the province you previously lived in. Your employer can not legally hold your paycheck. Talk to the Labor Board....they can give you a form to fill out to basically then have your previous employer investigated. (something like that anyways) Then call your former employer...advice them that you have taken these actions. Hopefully that will put a fire under their butts.

Oct 1/09 - I-751 package sent

Oct 3 - package delivered

Oct 5 - NOA mailed

Oct 13 - 1st NOA received and additional letters for my daughters I filed with. NOAs stated Resident Status

has been extended for 1 year and that we will be receiving a letter for an ASC appointment for

fingerprints, photo, and signature.

Dec 2009 - Received 10 year permanent resident card.

Feb 2010 - My children received their 10 year permanent resident cards.

Oct 2010 - My children were legally adopted by my USA Citizen husband.

thanks all. I'll try someone in payroll today, and if that doesnt work, go for the other suggestions. Though I will have to go straight to the labor board as none of my family or friends are even close to the city unfortunately.
