B2 visa question

How likely is it for my fiancée to get a B2 visa? I am a Russian-American, born and raised in the USA, currently residing here. She is 18 years old, she is a student, she does not work, she lives at home with her family. She would like to visit me and return back to her country (Russia), to return to school in the fall. Any comments or ideas would be gladly appreciated. Thanks!

If she were to get rejected, does it affect her from coming back to the USA on another visa, such as a K-1 visa? At the current moment of time, she just wants to finish her education before living with me, so she wanted to spend the summer here with me, and return in the fall.

It's unlikely because young, unemployed Russian women tend to overstay their visas and stay in the US. At least that's what the Embassy always assume, because it happens a lot.

 

Rejection will not affect the K1 visa.

K1

06.02.2014 - NoA2

01.04.2014 - Interview.

03.2015 - AoS started.

09.2015 - Green Card received.

24.07.2017 - NoA1.

01.08.2018 - RoC approved.

Oh, I see. If she provided proof from her university, that she will indeed return in time for fall semester to start, do you think it will help? She is in her last year for her degree, so her education is very important to her right now.

She can visit during the K1 process, but getting B2 visa might be more difficult then - since she already has an immigrant intent. If she has strong enough ties to Russia, she will get the tourist visa.

I may slightly help, but a school is a pretty weak tie to return home. It's not a big hurdle to find another school while in the US. Or, to put it more precisely, others have found decided to stay/overstay and found another school to complete their studies.

Yes, she can visit with the K-1 pending. That said, it is documented immigrant intent so proving sufficient ties to return home to overcome that tie to the US is not easy. Her age, probable lack of income of support herself in the US since she's a student (nobody can sponsor her), lack of current employment, having a US boyfriend, having a pending K-1 petition, etc. set a decently high bar.

 

She is free to try and I wish her luck. But her chances of success at obtaining and using a tourist visa is pretty low.

I understand! Yeah, I figured it would be difficult for her to get a tourist visa. Thank you so much for the great info and input! I appreciate it! I will go with the K-1 route.

Very unlikely (got approval). But no harm to try, you have just lost some money for the visa fee.

 

Here my experience:

 

I was journalist (editor) in my country (2010) with 10 years work of experience in one of most reputable companies. I brought a lot of papers such as from my company stating that I will going back for my job duty. I also have land/property under my name, bank account, credit cards account and I got rejected papers instead. 

 

The input?

 

Try to ask people in regional forum. Probably they have different views from me. Good luck!
