Hi all, 


I am working as 1ST year OPT, which will be ended by this August. On the meanwhile, I have applied to I-485 based on marriage to a USC. 

Due to recent political climate change and anti-immigration policy, I would like to maintain legal status until I finally receive green card. f

In order to do so, I need to apply to STEM OPT, which my major is included and employer is willing to do. 

 

The question is,

some told me applying to I-485 will negatively influence STEM OPT extension application

since I have already shown intention of staying in US permenantely by applying to I-485 others told me it won't matter.

 

Does it matter? Or fake news? 

 

Also, I heard that applying to STEM OPT and receiving a notification letter from USCIS (not EAD card) will automatically extend my current EAD card for 60 days

to avoid the inconveinence. 

Is this also true?

Not "anti-immigration", anti "illegal immigration"...people really need to listen to the proper wording..

 

As soon as you submit for the I-485 (EAD and AP also), once you receive the NOA1 for that, you are in a legal status pending decision on becoming a LPR.  So while you may not physically have the GC, you still will be legal to remain.

08/15/2014 : Met Online

06/30/2016 : I-129F Packet Sent

11/08/2016 : Interview - APPROVED!

11/23/2016 : POE - Dallas, Texas

From sending of I-129F petiton to POE - 146 days.

 

02/03/2017 - Married 

02/24/2017 - AOS packet sent

06/01/2017 - EAD/AP Combo Card Received in mail

12/06/2017 - I-485 Approved

12/14/2017 - Green Card Received in mail - No Interview

OP, you may not have applied for a new EAD since you already had one, but I'd apply for one ASAP - this time based on marriage, category (c)(9). This way you don't have to pay (woohoo! just include the NOA for your I-485 application). Hopefully, you'll get your EAD card before your current one expires - because you can't continue working without a valid EAD

I don't think you qualify for STEM OPT anymore since that's based on F1 non-immigrant status, and you applied to adjust to immigrant status.
