Hi ,

Recently I have filled I-130 form for my Spouce from California state and now I am planning to move to Texas state. Is it not advisable to change state while one has filed for CR1 visa . Please advice. Thanks in advance!

Hi Arpan


I moved countries while in processing and while it was a process to get it changed, it didn't cause any issues or delays. There are procedures for address changes to follow which make it quite straightforward.

Got married: 26th Sep 2013 

I-130 Petition Process:

Sent petition to USCIS Chicago lockbox (via in-laws to put check in US$): 11 Mar, 2016

NOA1: 24 Mar, 2016 (email notification 30 Mar. Hardcopy 11 Apr)

Service Centre: NEBRASKA

NOA2: 3rd Aug 2016

Petition sent to NVC: 18th Aug 2016

NVC Stage

Case number assigned: 8th Sep 2016

Paid AOS Fee: 9th Sep 2016

Paid IV Fee: 14th Sep 2016

DS-260 submitted: 25th Jan 2017

AOS & IV Package sent: 25th Jan 2017

Expedite requested: 25th Jan 2017

Expedite approved (consulate only): 1st Feb 2017

Scan Date: 31st Jan 2017

Case Complete: 14th April 2017 (10 weeks 4 days)

Hi,
I am in a hassle and need help. 
Some background on my case:
I am a US citizen and had applied for CR-1 visa (3 months back) for my wife (currently She is in India) and our application will get processed by Texas Services center. It looks like it will take forever, atleast 1-1.5 years until she can get the visa so I am looking for options to stay together. Me and my are thinking to move to Europe on Visa till the time my wife gets the Greencard. Or if this does not work out then I will move to India with her. But in I-130 form, I have mentioned my US address and her's Indian address. Is it ok to move out of our location to some other country while the application is in process ? I have read somewhere that "If you and your spouse are planning to remain outside the US indefinitely, it is not recommended that you apply for a Green Card. The Green Card could be cancelled at the Port of Entry to the US if you have spent more than six months outside of the US. The Immigration Officer at the Port of Entry will have to determine if the US is your main home, so be prepared for a lot of questions."

Will there be any consequences for the same? Are there any changes that I have to made in my application. 
Is there any option that we can stay together other than me moving to India?

I will really appreciate you help if you can help me in any regard. Thanks in advance.

In general you will be ok as long as your wife does not travel to the US while the CR-1 is being processed. Both of you can move to Europe or India or anywhere. I will just make sure that USCIS has a current address for your case. The above will be perfect a slong as you keep the CR-1 process going and travel to the US withing 6 months of the visa being issued.

 

What you've read regarding Green Card being cancelled because of spending over 6 months outisde the US regards to the fact that once your wife has obtained her CR-1 visa, entered the US and obtained her Green Card, there are veyr specific limitation regarding the ammount of time she can spend outside the US in order to not loose her Green Card, however going back to the first idea, if she or both of you are living in Europe or India will not affect her process.

 

Finally keep in mind that if she is not living in India in the future, but her application was processed as such, she will have to travek constantly once both of you get to US Embassy/consulate processing

Before visa issuance, your wife (or yourself) is not held to any US residency requirement. You both may stay in any country. If she wishes to complete consular processing in any country but India, she needs a residency permit in said country (not just a visitor visa).

 

You must also consider that you (the USC) need to retain US domicile while abroad, and also be aware that foreign earned income does not count on the affidavit of support.

If it isn't difficult, it isn't worth it.

That isn't quite how long the wait is. CR1 is approx 12 mos if there are no RFEs.. and docs are in order.
