I am a U.S Citizen, I applied for my husbands green card when we got married. He is a Mexican citizen and came here to the USA with a visitors B1/B2 visa. Forms I-130 and I-485 got accepted but form I-765 authorization for employment got rejected due to filing fee and also it said there is a new version available. I have two questions- 
1. Do I have to send in the new fee? Or is there no fee due to the fact that we submitted I-485 and paid that fee and it's pending? 
2. Question 11 asks "Have you ever before applied for employment authorization from USCIS?" (It says if yes to attach documents and if it was granted or denied), do I say yes since the other one got rejected? Or does that not count?

1. You need to send in the I-797C Notice of Action for the I-485 to prove that you are going through AoS.

 

2. As far as I am aware, the answer is no. Your application for I-765 was never actually processed. (You were never granted or denied)
