Hi everyone!  We are waiting for our NOA2. I, being the planner in the relationship, am researching what we can do to be ready. I have a few questions...

 

I read on the embassy website that if a person does not have a birth certificate, a notarized affidavit from the parent can be brought in as proof of date of birth. Has anyone experienced that? He applied for a birth certificate to be sent, but it's a long process because they weren't made standard until after he was born. If the NOA2 comes quickly, he might not have the birth certificate in time for the interview.

 

Can the medical exam be scheduled before the notification from the embassy arrives? I've heard that the police certification is valid for a year, so he is planning on doing that soon. But what about the medical exam?

 

What is the average wait time for scheduling the interview once the embassy sends him the notification?

 

I don't think we have any red flags (we practice the same religion, he speaks English very fluently - maybe better than me-, he's only 8 years older than me, his family loves me and approves of our relationship). Any tips for our interview? Things we should be prepared for?

I did not have a birth certificate and I submitted notarized affidavit from my parents ( mother and father separate affidavit) and also added my high school certificate which mentions my date of birth. Even though the website says, notarized affidavit OR high school certificate ( I submitted both) is enough for date of birth proof, I still got a checklist after 9 weeks of waiting for document review. NVC asked me to get a Non Availability of Birth Document from my place of birth Local Authority. This happened in Feb2017. I did try to contest the checklist but to no avail and had to submit the non-availability certificate. This one checklist pushed my case completion by 2 months! The clock restarts when you resubmit any document.

 

So you can decide whether you want to take your chances with only the notarized affidavit from parent for Birth-proof. Non availability is obtainable easily within a day or so from the local authorities.

It is advisable to wait for the interview email before scheduling the medical appointment. Medical exam doesn't take to much time.You can get it done about 10 days before the interview and there are sufficient appointments available for medical exam. I am getting my medical exam done 23 days before the interview. There is usually a gap of about 30 days between the interview notification and the actual interview.

The medical center will not allow him in without the official note.

An India K1 member recently posted they tried exactly that and were rebuffed until an official notification. Guess the medical centers have caught on to Delhi folks trying to beat around the system.

I am so sorry to hear that! Was it difficult to get the birth certificate? My fiance is from Kerala but currently lives in Delhi and it seems to be a huge challenge. His brother-in-law lives in the town where my fiance was born, so he is helping him with the process but it seems to take forever. We still have not received our NOA1, so hopefully he will get the certificate before the interview.

We should have done that in the first place because it delayed out process by about 6-8 weeks. 

Oh well. He's here with me know. :)

Where is your husband from? My fiance was born in northern Kerala and he applied for the birth certificate 2 months ago and still hasn't received it. Apparently they are asking for more documentation. Now I'm afraid that he won't receive it in time. We're still waiting for the NOA2 but we're expecting it any day now.

 

Does your husband have any tips for getting the birth certificate?

My husband is from Delhi. 

How old is your husband? 

Has the NVC accepted the affadavit and school records? If so, why bother with a bc? We had to SUBMIT the bc to NVC to even get our NOA2. 

My husband said it took about 4-6 weeks to get his bc, but he had to continuously keep going in person. 

I dont understand my husband's explanation about bcs in India. All he says is he what more documentation does the Indian government need from your husband?

Part of the problem is that he was born in Kerala but lives in Delhi, so he can't go in person. He is depending on his brother-in-law to take care of it for him. He is almost 41 (born in 1976) so his birth wasn't registered, so it's not a matter of just getting the certificate. Oh, and we're not married yet, so we're doing the K1 visa. He won't need his birth certificate until he goes for the interview.

Well it is now the middle of June and we are still dealing with this same issue! We just received the NOA2 so it's crunch time now. Every time his brother-in-law goes to the office, they ask for MORE documentation! Now they want his siblings' birth certificates, his mother's signature, and his baptismal certificate. It's so frustrating! I am so ready for this whole thing to be over!:angry:

My original birth certificate is gujarati language and name in Birth Certificate (NIHAR) is different from Passport (NIHAL), my all document have same name as passport apart from Birth Certificate. I checked the NVC website and it said that you can submit the Matriculation certificate (issues by school board with birth date) so I was planing to submit it. but now I see this way chance of getting REF is high.

 

So I am thinking to submit below documents. Please review and let me know if this can be better.

 

Translate original BC to English - get it notarized - Attach Gazette Copy
1.1  - original BC in Gujarati 
1.2 - English translation with Notarized.
1.3 - Cover letter explaining name change proof registered in Gazette copy issue by Government of Gujarat.
1.4 - copy of Gazette from Government of Gujarat. which have entry of name change.
1.5 ( Optional ) - Certificate of the birth issued by Government School Board ( Matriculation certificate )

 

Naturalization - N-400 Timeline

09/09/2020 - N-400 filling done online

09/09/2020 - NOA online

02/11/2021 - Bio Reuse
