Hello guys, I'm new to this forum. Could you help me out with any useful information for my case which is:

 I came to US on a tourist visa mid last year. I got married to my USC spouse in December. He filed for my AOS and my interview in scheduled for next month. However, he has been verbally, mentally, and financially  abusing me since we got married(I don't want to go into the hurtful details), and now he is filing for divorce. I understand that without him, the i-485 will be denied. I believe I qualify for VAWA and I will be contacting a lawyer soon for this purpose. My question is;

 

1- When will my priority date be if I file for VAWA with i-485 this month or next?

2- Will divorce affect an already submitted VAWA application?

3- How will I know if my husband has pulled out his affidavit of support since we are now staying separately?

The first question is about vawa  is do you have significant proof of all this abuse? If you don't then it will be really hard to claim and prove VAWA.

1. There is no priority date for spouses of USC, only spouse of LPR have priority dates

2. Divorce will not affect vawa application. You can file vawa until 2 years after divorce 

3. If your husband pulls the affidavit of support, they will send you a letter saying that your i485 has been denied. You will know he has pulled it once you get a denial. 

 

As for vawa, make sure you have concrete  evidence of abuse, police reports, restraining orders etc 

 

if if you cannot prove abuse and bonafide marriage. Your vawa will not be approved

Thanks for the information. My marriage is bonafide, but if my husband pulls out his affidavit of support on scam marriage claims for GC, then how do I convince USCIS that he is telling lies?

Just submit your vawa with strong evidence that it's a bonafide marriage. The vawa officials are well trained and will be able to tell if you have told the truth and if your marriage is bonafide. Basically if you can prove that the marriage is bonafide and you have a strong case of abuse, you should be fine
