Hi

 

I have query about my in laws i130 case. My father in law's sister sponserd his family 15 years back. I30 is/was approved. At that time, my inlaws was not interested in us immigration so my FIL's sis stopped further responding to uscis. Now, my FIL and his sister has passed away. So anything can happen in this case so they can come to US?

 

PS: my husband already in usa now on his own.

Both the petitioner and the beneficiary is passed away so I can't see how you think the case should go anywhere?

 

If your husband is here and he has a GC or he is citizen he can apply for his mother.

No that can't work like that. 

 

When he becomes a USC he can apply for his mother to come that will take about a year.

 

Siblings will be 15-25 years (If still possible when that times comes) depending on their homecountry.

 

It would be faster for him to apply for the mom and then the mom to apply for the siblings.

 

but this is going to take MANY years. There is no way he can get them to come now.

it doesn't work like that, just because you want them to come doesn't mean they can come fast

 

his mom will take a year after he becomes a USC

 

siblings are the last preference, as well as children over 21, they aren't immediate relatives and take a very long time to come

I understand the desire to all be together in the same country, but to be blunt that's not what the immigration system is built to do. The assumption is that when you marry a foreign spouse and immigrate to be with him/her, you are leaving behind your life in your home country and starting a life with your foreign partner.

 

Now, there are previsions to bring other family members as you've seen described above, but they will take a couple years (parents) to decades-if-ever (siblings). The assumption being that your parents are not necessary for you to live in the US with your new family...note that I am referring to immigrating to the US, not visits (seeing family members is still important!). Is it desired? Sure. Is it necessary for the LPR or USC to function? No. As such, they have a lower preference for immigrating than people who are waiting to be with their spouse, children, etc, who have a need to be with the person living abroad.. The same goes for siblings - they have the lowest preference because having a sibling live in the US with you is considered (for the lack of a better term) unnecessary.

 

I hope this explains the situation and why there are delays (beyond just backlogs and paperwork/bureaucracy).

   The original petition was to united your FIL and his sister and they are united, just not in a way that benefits the rest of the family.  There is no way to do anything more.  You and your spouse need to decide which country to live in if being close to his siblings is important.

This will not be over quickly. You will not enjoy this.

If he is struggling with being apart from his family have you considered a move to his home country?

Doesn't matter what you want unfortunately, but rather if the intending applicant is interested. Once your hubby is a USC, he can petition his mother in Pakistan. His siblings have a decades-long wait.
