Hi everyone

 

I have a quick question. How soon after I become a US citizen I can sponsor my Parent? Is it immediately?

 

Both parents are in the US, entered the US legally, but overstayed their tourist. 

 

I would need to file I130 and I485 at the same time? 2 sets of these If I am not mistaking?

 

How long does the process take?

The guides for filing for parents, linked to from the Visa Journey immigration guides is a good place to start to answer all of these questions.

 

It appears that you can file for your parents immediately upon receiving US citizenship. The approval of parental applications will not be immediate, however. You might peruse the Parents forum to get an idea how long it takes.

Mom- I-130 and I-485 at the same time - Payment for each?

Dad-  I-130 and I-485 at the same time- Payment for each?

 

Both parents in the United States.

 

 

Do i send it in one envelope?

 

Has anybody actually on this forum went through the same exact situation as mine above?

I am ready to fill and submit for my parents. Just have a few general questions.

 

1. My dad back in 2005 had won a dv lottery, and then proceeded to apply for AOS within the United States. If he was assigned an A number, Do I put that A number on the I 485 application for them? 

 

2. I 864, Regarding the household size etc, My parents are in the United States and overstayed their visa ( long time) What do I put when asked for Household Size or the address?  Will I Have to use my household size plus 1 for each application or it is 0?

 

3. Do we still need to file the medical for both parents, if back in 2005 they already had it done due of winning that dv 2006 visa lottery.?

 

I was searching this forum and others. and I think this case might be unique due to that dv 2006 ( My dad was denied) 

 

Please if anyone can give me pointers on how to file properly or any other information that might be crucial to the process it will be greatly appreciated.

  Your parents will need new medical and police reports.  If your father was denied DV was he told to leave the US ?   If he has a deportation order against him his case get more complicated.  For their household size  , are thy each living alone ?  are they together ?   For your household size  ,  it is your family unit plus the person you are sponsoring and any other person you have previously sponsored that you are still liable for.   You can send everything in one envelope but each petition must be compete in it's own.  2 copies of your citizenship papers, proof that you are related to each parent.  Think 2 envelopes inside one big envelope.   They will also need police reports. 

This will not be over quickly. You will not enjoy this.

No, he was never told to leave, and there was no order against him. 

 

What police reports? I have read the instructions and if you have a clean record, no crime, then what would be the Police record for?

 

Yes they are living together, at a different address then I, hence I asked what to put on the Support Application household size.

A police report for every country that they have lived in for more than 6 months after the age of 16.

 

The police report is for background checks. USCIS will not just take a persons word for it which is no offense to your parents. They want to see legal documents as proof.

^^^ I have never heard of this, that you need a police report if you are clean. If you were involved in something bad then yeah. 

 

I have done many applications for me and wife and never had to do a police report for USCIS. No offense guys, but I think you have been misinformed.

Directly from USCIS

You should submit the following documentation and evidence to apply for a Green Card as an immediate relative who is already in the United States:

  • Copy of the Form I-797, Approval or Receipt Notice, for the Form I-130 petition filed on your behalf (unless you are filing Form I-485 together with the Form I-130);
  • Two passport-style photographs;
  • Copy of your government-issued identity document with photograph;
  • Copy of your birth certificate;
  • Copy of your passport page with nonimmigrant visa (if applicable);
  • Copy of your passport page with your admission  or parole stamp (issued by a U.S. immigration officer) (if applicable);
  • Copy of Form I-94, Arrival/Departure Record or copy of the U.S. Customs and Border Protection (CBP) admission or parole stamp on the travel document (if applicable)  

Note: If CBP provided you with an electronic Form I-94 upon your arrival/admission to the United States, you may print out a paper version of the Form I-94 from the CBP website at www.cbp.gov/I94;

  • Certified police and court records of all criminal charges, arrests, or convictions regardless of final disposition (if applicable);

This will not be over quickly. You will not enjoy this.

Ok?  "If applicable" is the key phrase here. 

 

In my opinion if you are clean, and had no history of crime or ever been arrested, then you are fine and there is no need.
