My spouse has been trying to get a medical exam for over a month now. The place he found is giving him a lot of issues. He's from Southeast Asia so they found what appears to be TB. However, reading many places I see its a false positive for many people.

However, again, it's been almost a month. The clinic they went to do NOT care and do not try. He asked a friend for recommendations and stated another clinic to go to. He went today and they said they did not want to interfere. They need the results from the first clinic to go any further (which they have been ridiculously stalling for so long to give). I felt like we got scammed from this place.

 

What are my options here? We are running on such a small time to get everything submitted. Is it possible to submit it without the exam and have it ready when they ask? Or is this one of the paperwork that NEEDs to be submitted with the AOS?

As a nurse in the US, TB is a big concern. Just because others have false positives doesn't mean your spouse doesn't. He needs to get checked for his health most importantly. He will need to be on medication for several months. TB can be deadly if not treated. 

 

If you don't agree then go get another opinion but start treatment while editing as soon as possible

Yes I understand that he may be a true positive I completely understand that. My problem is the clinics. The one he first went to do not do TB treatment so he's being referred to a different facility. But that facility is not cooperating.

 

My ultimate question is if I can send the medical exam later than the AOS package? And they'll ask for it later? Or is sending without it an automatic denial?

He has to get a chest x-ray to rule out TB. My husband had the same issue, but really he had the TB vaccine in his country so he will have false positives because of that.

OP is submitting medical for AOS, not a visa, so won't be going to a consulate.

 

OP- sometimes they will rfe for the medical and sometimes they will ask to bring to interview but they won't reject for it, if that's your question. Sorry about the hard time they are giving you - try to stay on their case until they will help.

you dont have to submit medical right away. i didn't. my lawyer said that medical can expire after 1 year and AOS is a long process so we submitted everything but medical. he said to wait for interview notice and do medical then. they wont deny it or anything, they'll send you a notice saying u need medical (i havent received it yet, guessing when interview is near, they'll send one) but my lawyer said u can wait till u know u have an interview then get it done. lots of ppl do it first then it expires cause the AOS takes longer than 1 year then they have to pay to do it again. so its an option to look at. hope that helps!
