tas what i understood after researching a lot about it in forum. if not getting cleared in 2-3 days, it can take weeks, months or even years :( good to c somebody got same msg lol. really hope and pray our cases ll take shrtest possible time. ll let u know if i get any further updates!!

For unknown reasons (even to USCIS adjudicators), a background check may fail. If this is the case any number of secondary checks come into play (depending on the reason for failure). These additional checks are run through other agencies (e.g., FBI, Department of State, etc) and they each have their own timeline. This process usually delays the petition approval anywhere from 1-6 months.

The Petitioner and Beneficiary are subject to background checks? I thought only the beneficiary was.

Apologies, I need to clarify. The petitioner is subject to background checks if s/he is a green card holder. US Citizens are not subject to any checks.

Petitioners (USCs and LPRs) are definitely subject to a background check as well. They need to be sure the beneficiary is disclosing all criminal activities, especially those that may make them a risk to the beneficiary.

Hi everyone, i've been searching for a similar situation to mine and came across this thread, i'm a USC and i filed my i130 for my spouse on 04/15/2019 Nebraska SC, and got transferred to Vermont SC on March 2 2020, and then stuck in background check. 

Nothing since then, i keep making inquiries and same response ( you have to wait till the clearance is over).  

 

I would like to know how long it took you guys to be done with this process. I know every case is unique and it's different from one another, but 17months of waiting is frustrating and would like to have some kind of relief.
