Its been almost 200 days (PD Oct 4, 2016) and we are still waiting for approval. Here is the response which we got from Senator when they contacted USCIS

""USCIS records confirms that the case is in pending background check clearance. USCIS is committed to adjudicating these cases in a timely manner while also ensuring public safety and national security. A small percentage of cases have unresolved background check issues that temporarily delay adjudication. Although USCIS makes every effort to resolve such cases promptly, USCIS is unable to speculate when the background check will be completed"" 

I read somehwere in VJ that it can take upto several months just to complete this background check. We are totally devastated to hear this news after waiting already for such a long time. If anybody has gone through similar experience, How long does it took to clear such background check? please share. It would be really helpful!!!

I read somehwere in VJ that it can take upto several months just to complete this background check. We are totally devastated to hear this news after waiting already for such a long time. If anybody has gone through similar experience, How long does it took to clear such background check? please share. It would be really helpful!!!

We have been in AOS background checks for a very long time.
Filed AOS in May 2015

Interview Sept 2016

Multiple service requests and senator inquiry have been useless.

NVC Received : some dinkelsberry yehoo in the house of clingons send our petition to the wrong consulate.

Consulate Received : July 30,2014 Transfer to right embassy complete.

Interview Date : Oct 22, 2014

Interview Result : AP , requesting another PC (not expired) and certified divorce decree (was submitted)Stokes interview via phone for petitioner 4 hrs after interview.

Oct 23 email notification visa approved.
Visa Received : Nov. 3 , 2014 VISA IN HAND.

US Entry : Nov. 21, 2014

Marriage : Dec 27, 2014

AOS send : May 12, 2015, received May 14, 2015 USPS priority

Email &text : May 18, 2015, check cashed May 19,2015, return receipt May 21, 2015 stamped USCIS Lockbox, NOA1 (3x) May 22,2015

Biometrics : June 1, 2015 letter received for appointment June 8, 2015, successful walk-in June 1, 2015

RFE : June 12, 2015 for income not meeting guideline. Income does ( ! ) exceed guideline.

RFE response : June 26, 2015 returned with a boat load full of financial evidence.

UPDATE: July 5, 2015 updated on all 3 cases, RFE received June 30, 2015.

Service request : Aug 12, 2015, letter received that it will be processed within 90 days from receipt of RFE.

UPDATE: Aug 24, 2015, EAD card being produced/ordered. ( 102 days from AOS receipt day and 55 days from RFE response received.) Thank you Jesus !

Emails : Aug 24, 2015, EAD approved, EAD card ordered.

I-797 EAD/AP approval notice received : Aug 27, 2015

EAD/AP combo card mailed : Aug 27, 2015, EAD/AP combo card received: Aug 31, 2015

Second Biometrics appointment letters received for EAD and AOS on Aug 15, 2016 for Aug 17 ( 2 day notice).

Third Biometrics appointment letter received Aug 19, 2016 for Sept. 1, 2016. WTH ?!

EAD/AP (renewal) approval Aug 22, 2016, NOA2 received Aug 25, 2016

Renewal EAD in production notification text and online, expedite successful 4 days after RFE request response was faxed, Aug25mailed,Aug29received.

Sept. 21 Interview, 2 hour interview, we were separated and asked about 50 questions each for an hour each. IO was firm but professional, some smiles.
Several service requests made, contacted Senator and Ombudsman. Background checks still pending.
July 21, 2017 HOME VISIT.  Went well. Topic thread in AOS forum.
Waiting to skip ROC and get 10 yr GC due to over 2 year while pending AOS
AOS APPROVED Oct. 4, 2017 * Green card in hand Oct 13, 2017 !!!!!

First K1 denied after 16 month of AP. Refiled. We are a couple since 2009. Not a sprint but a matter of endurance.

It depends on the petitioner's background. If the petitioner has travelled and/or lived abroad, I assume the background check will take much longer compared to someone who's lived in the US their whole life. The same for name changes, a lot of address changes etc or if the petitioner have several previous foreign spouses and divorces, then I assume that's something that may delay the background checks too. 

 

If you're stuck on background checks then unfortunately, there is nothing the Senator can do. You just have to wait it out. :(

I know this is really hard to absorb, but I don't think there's much you can do. I asked my lawyer about your case today and she basically said that there is no way to learn anything about background checks (i.e., what's being checked? where is it being checked? when did the checks begin? when will the checks end?). Not even a US Senator or Congressperson can learn more about this process or help to expedite it. It seems incredibly unfair, but there's not much that can be done.

 

More over, I don't think knowing much about other people's timelines will be all that useful. Every application is sort of unique when it comes to background checks. My lawyer (who used to work at USCIS) basically told me that each application is subjected to a set of common background checks and then depending on certain factors a whole different set of background checks can come into play. Even worse, if some these background checks reveal anything, the application can then be subject to even more background checks.

I wish I had better news for you!

Thank you very much for clarifying with your lawyer. I was just wondering if its gonna be a background check for petitioner or beneficiary or both.  Planning not to involve senator further in our case until it gets approved since we somehow feel now that contacting them multiple times might have ended up in this situation. May be just pointless assumptions. Need to have tremendous patience now, which we didn't show earlier.

I was told the exact same thing. It seems most people get it cleared in 72 hours, but if it isn't cleared quickly, the wait time is random. Sometimes a few weeks, sometimes a few months.

I've been curious if my requests for expedite caused us to get into this situation...

Seems like this is likely true. My lawyer used to work with USCIS and said both petitioner and beneficiary are subject to background checks. Most pass within ~2-3 days. For unknown reasons (even to USCIS adjudicators), a background check may fail. If this is the case any number of secondary checks come into play (depending on the reason for failure). These additional checks are run through other agencies (e.g., FBI, Department of State, etc) and they each have their own timeline. This process usually delays the petition approval anywhere from 1-6 months.
