New I-134 (Affidavit Of Support) K1 Visa Help please!

Timeline

I am currently filling out the latest version of I-134 form (Affidavit of Support) for K1 Visa. My fiance is from the United Kingdom. It is a little confusing and I was wondering if anyone could help me with some questions I have. 

A) I am a natural born citizen of the US. Do I check anything for Part One, Question 12 under Information About You.

B) My fiance has a child but he will not be immigrating at this time. How would I mark Part 2, Question 12 under Information About Beneficiary. Do I leave it blank?

C) How do I answer Question 38? 
D) Are copies of income tax returns sufficient or do need to obtain a IRS transcript?
E) Any questions that don't apply to us, do I mark N/A, none or leave it blank?

 

Any help would be greatly appreciated.

Any help would be greatly appreciated.

A) Submit a copy of your birth certificate and a copy of your US-passport(biographical page only) to proof that you were born in the US.

B) Fill it out but mention on a separate sheet that the child won't be applying with him right now.

C) mark "Do not intend" because it is a Fiance visa. USCIS knows that you have to support your non US-fiance.

D) Provide your W2, your latest tax return (2015 or 2016), a few pay stubs and a letter from your employer saying that your work for his company including your annual income, working hours per week, your job title and if you work part or full-time)

E) see part 2, number 4 for example: He doesn't have a SSN yet so write down none. N/A means not available. Same goes for part 1, number 8 and 10: You as a US-citizen don't have any of those.

You husband will get his A-number when you receive NOA1 in the mail. Leave part 1, number 11 and 12 blank.

05/28/20: New Card Is Being Produced

05/29/20: New Card Got Approved

06/02/20: We Mailed Your New Card

06/03/20: The Post Office Picked Up Your New Card

06/04/20: Card Was Delivered To Me By The Post Office

A) No. The statement "If you are not a U.S. citizen based on your birth in the United States, or a non-citizen U.S. national based on your birth in American Samoa (including Swains Island), answer the following as appropriate:" excludes you from answering all part of 11 and 12,

 

B) Name the child and details. This is biographic about your fiancé and not an application for a child's visa.

 

C) See this VJ example form http://www.visajourney.com/examples/Form-I-134.pdf. It's a different version, but #11 is the same questions. That response has worked for many from the UK. 

 

D) Either is fine for London. They don't even require a tax return for an I-134. 100% sure of that. They have approved on an employer letter only. You may want to choose two proofs (2016 tax and letter), but it is not a huge deal at a London interview. 

 

E) N/A starts for "not applicable". If you have not read the instructions for filling out the I-134, you need to read and follow this;

"Answer all questions fully and accurately. If a question does not apply to you (for example, if you have never been married and the question asks “Provide the name of your current spouse”), type or print “N/A,” unless otherwise directed. If your answer to a question which requires a numeric response is zero or none (for example, “How many children do you have” or “How many times have you departed the United States”), type or print “None,” unless otherwise directed. "

I was wondering the same things! Thanks for the great answers, everyone. I also have another question pertaining to the I-134. Do we really need to include bank information if our salary is sufficient income? It just seems like a pain to get the bank to provide that much detailed information.

The law (Foreign Affairs Manual) states only that the interviewing officer has to be convinced that the K visa application won't become a public charge. It doesn't actually mandate an amount, or how it has to be proven. I think each consulate has their own local vibe of how easily the officers are convinced. What is acceptable in London may not convince an officer in Manila or Sydney. London will approve with no tax return. They will approve with no I-134 at all from the fiancé if they line up another suitable sponsor. And they will approve with no sponsor/I-134 if the immigrant has a considerable amount of assets.  It would be best to seek out people in your regional forum to see what is generally required at your specific consulate because it is somewhat subjective.
