Hello, we are worried about the process of AOS. Technically, we believe we satisfy all the criteria stated in the I-485 instructions. But having read stories on the forum about money needed, we are getting concerned. We are not in the US yet, but fear the journey would be rough. Here is some background:

 

  1. The USC and the alien have been living together both inside and then outside the US for a few years. Currently they are outside the US.
  2. The USC has not been having income, therefore, has not been required to file tax return. Therefore, we are using savings to satisfy the money needed.
  3. The alien has savings of about US$70K, which is more than 3X the poverty line. This should be more than enough according to I-485 instructions.
  4. There are no friends or family who could sponsor the alien.

 

The questions are:

  1. We have heard cases similar to this: a couple were requested by the USCIS to provide tax return or find another sponsor after having provided evidence of 3X the poverty line of savings. Is this often the case? We are quite afraid of being requested further evidence of income/savings, which we cannot provide, and then being denied and having to leave the US. What can we do before we depart for the US? (The thing is we really have satisfied the stated conditions in I-485. If the USCIS is not satisfied, we are really out of solutions.)
  2. The alien has lived in the US before, so he still has a US checking account. But his current savings are in his home country. Which is the best way to show the evidence of savings?
    1. Wire the savings to his account in the US and then ask his US bank to write a letter stating his balance.
    2. Request a bank draft in US dollars from his foreign bank and use it as evidence for AOS before he deposits it in his US bank.
  3. The alien plans to continue to work for his company of his home country remotely as a software engineer with a salary of about US$80K in the long run. In case USCIS requests further evidence of money, could this help?

I suggest you take a look at the form and the instructions for the I-864.

They do ask about the alien's possible savings and income so that should help you. I myself would deposit the money into a US bank because I think it would look better. Also it would be great to get a letter from the employer about the continuing employment, however, it is possible that the alien would have to stop working during AOS until they get their EAD, and the company should also address that.

Hope this gives a bump to the post so you can get better answers as well.
