Hello Friends,

 

My wife is a USC and we filed for I130, I485, I131 and EAD on 3/4/2017. Biometrics on 4/15/2017. I am currently on valid H1B status (valid till 12/2017) but my H1B visa stamp has expired. We plan to travel abroad on 6/11/2017. This gives us 99 days to get an AP, but if the AP does not get delivered by then:

1. Considering I am on valid H1B status and leave USA, can my wife mail the AP document to be abroad?

2. If not, I will have to go for H1B stamping, will that affect my AOS in anyway?

3. What are the chances of getting AP in 90 days?

You said your H1B is expired that means its not valid. No you can't leave with no AP with you. No she can not mail it to you. You must have before you leave. I would say about a month before you leave kike this time next month no EAD/AP make an INFOpass apt and request an emergency stamp. Maybe you might get it.

 

Don't know about 90 days been hearing over 100 days they are backlogged.

Thank you for the info! I will look into the info pass option.

The H1B visa stamp is certainly expired, but I have valid H1B status and I94 till December 2017. This means if I leave the country, I need to get a fresh H1B stamp against my valid H1B status and reenter. I hope that will not cause my application to be considered abandoned.

@DecisivePoet131 - sorry to bump an old thread, but wondering what course of action you went through? My AP is still pending (counting today 132 days). Any help is much appreciated!
