Does she have any reason/need to visit her home or other foreign country in the next 3-4 months?

**Post moved from K1 Progress Reports to AOS from tourist, work and visitor visas. 

 

She can adjust status now. She won't able to leave the country until she receives Advance Parole or Green Card

you can file for a cr1 visa which will let her be able to leave and visit family and get her stuff moved here. having filed for it then leaving shows that she is abiding by the rules which will increase her chances of being able to visit while it is in process. if she is denied because of immigrant intent it is a non issue for getting the cr1 since it is an immigrant visa. you can file for the visa now to get the clock started e en if she is in the us.

Immigrant intent is a non issue no matter which route they chose to go, she cannot be denied AOS due to immigrant intent alone.

 

To the op, the quickest and easiest route to take would be for her to stay in the US and file her AOS from here. It will take anywhere from 3 to 5 months and she will not be able to leave the US until she receives her EAD/AP card. If travel isn't a necessity, this is the route to take, it's much less stressful and quicker.
