Physical Address of Beneficiary in I-130

Timeline

I am the beneficiary and my daughter is the petitioner to get the adjustment of status for me ( Green Card ). Right now I am in USA ( landed here just a month back ). While filling the I-130 Form in the page 5, part-4, for item nos. 11.a to 11.h, physical address of the beneficiary is asked. Whether I need to fill the USA address in which I am staying currently or the Address from where I traveled in India. Kindly clarify my doubt. Advance thanks for the clarification given.

If you're doing an Adjustment of Status, you'd put in the address you're at now, since you'll be there throughout processing.

Thank you for your clarification on my query. Mr/Ms Nightingalejules... Let me proceed as per your guideline. Kindly note that I have come here as a visitor to USA in B2 Visa and planning to seek for the adjustment of status. Which I missed to tell in my previous posting. Hope this will be fine.

Anytime. You may get some pushback on this site, because it's technically illegal (Visa fraud) to enter on a tourist visa with the intention to adjust status. But you're here now and as long as you don't leave again until you receive either "Advance Parole" (AP) or you get your green card through your Adjustment of Status (AOS), you should be fine.

My Daughter is the sponsor for GC for us (Parents). Currently we are in USA. We need to furnish the Birth certificate and Marriage certificate. Both were not recorded at the time of the event. Parents of the Beneficiary parents are not alive for Beneficiary Father and mother only is alive for Beneficiary mother. We could get non availability certificate for birth for both of us. For marriage we didn't get the same. In case of affidavit in lieu of the certificate, how to proceed further. Kindly note that no elder relative is alive for the beneficiary father. Can any one help me to find an acceptable solution.

  Is there some well known public person ( school, religious, government )  that can attest to knowing the facts.  The more official the person the more trusted a letter is usually considered.  If not then get several from regular people.

This will not be over quickly. You will not enjoy this.

Thanks for the instant response. I have the school record (SSLC book) stating my father's name and my passport has both father's and mother's name. Will that be sufficient ? If required I can get a letter from one distant relative younger than me by 8 years, working as senior officer in Government service.

 

And another clarification on the affidavit for marriage between me and my wife. If we can get the affidavit from my wife's mother, will that be sufficient ? or is it required to be obtained another one from my side relative for me separately ?

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

Hi,

I am filling the i-130 along with i-485 for my dad who is in US for last month on B 2.  My Q is similar to what Manohor asked above - if I need to fill in the USA address where he is staying currently for 

Form 130 -page 5, part-4, for item nos. 11.a to 11.h, physical address of the beneficiary ? This Q is for 130 form and not 485 firm. I do plan to put in the USA address for 485 form.

 

Also, has anyone faced issues, when applying for 485 while on B2 ?

Hi Manoharan,

I am in the same boat as you were. Did you get your GC ? Were there any questions/issues applying for 130 and 485 together while on B2 ?

Also, how long did it take to get your GC.
