hi

I really need help with a few questions.

 

I'm filling for AOS married to a USC, I overstayed my visa for 7 months, and when I pull up my i94 info it appears with info from my last trip in 2013 and not 2016 I call cpb and they told me is because I'm out of status thats why I'm  not able to pull up the 2016 i94.

 

 my question is, can I use that i94 for my I-485? or not?

and also what answer do I have to select on part 2 of the i485 do to my situation?

The stamp is also your I-94 info. Photocopy it and send it in.

I would print out the online info as well and attach an explanation about how the last trip is not showing up, and how you are out-of-status currently.

Your overstay will be forgiven as you AOS as the spouse of a US citizen.

If you are also filing an I-130 I believe you should pick a for question 2.

  • Day 28 - Jan-09-2017 - Successful walk-in for biometrics (Cleveland USCIS)

  • Day 45 - Jan-26-2017 - RFIE response sent 
  • Day 49 - Jan-30-2017 - RFIE delivered to USCIS @ Lees Summit, MO
