Hi my wife is a us citizen and  filed her taxes thruogh turbo tax and did it her self i didn't know how to file so she has been filing us single for the third year now we will be starting the roc process in  September I just wanted to know is this going to cause problems with my roc and if so can I do anything to straighten all this up. thank you

if you are not currently separated, she can't file as single and has to file as married, either jointly or separately. There's a question in Turbotax or HR Block with personal information where you have to check 'got married' the year you got married.

She'll have to file amended tax returns. I don't know how to do that but you can probably find out online or through talking with a tax professional.

What about yourself, if you're living in the US, are you filing taxes?

You should get this cleared up ASAP.

If she has used TurboTax for each previous year all her records are online through them. She should be able to make amendments to all years; then she will have to physically mail in these amendments to the IRS as wlel as any potential extra money owed(if any, maybe even actually do extra returns).

 

I had to just amend mine this year because of a mistake on 2016 W2 form from my company.... I owed $244...:( haha

06/30/2016 : I-129F Packet Sent

11/08/2016 : Interview - APPROVED!

11/23/2016 : POE - Dallas, Texas

From sending of I-129F petiton to POE - 146 days.

 

02/03/2017 - Married 

02/24/2017 - AOS packet sent

06/01/2017 - EAD/AP Combo Card Received in mail

12/06/2017 - I-485 Approved

12/14/2017 - Green Card Received in mail - No Interview

actually I didn't get a Ssn and work permit till almost 8 'months in I started work at the end of 2015 and she filed from those couple of months. I worked three jobs thru out 2016 and I filed this year 2017 she had already filed so the tax guy said I must file as single.

ROC does not require a tax return. People use them to show they file together as an indication of a valid marriage. Your tax returns do not support the fact that you are married and mix your finances. So don't use tax returns as evidence. Pick other things that show you mix your money and live at the same address.

I haven't looked at the actual requirements or list of documents but I'm pretty sure the tax returns are significant enough and carry a lot of weight in proving a bonafide marriage - more so proving comingling of finances. Just think about it this way, if you get asked for the tax returns and they see "Single" instead of "Married" - it will definitely be a big red flag against you.

 

I also suggest to get those tax returns corrected ASAP. You don't *HAVE* to file joint, you can file Married Filing Separately (MFS) - the point is to file as married and not single.

Tax Returns are important for ROC. I don't want to say the most important piece of evidence but it is pretty important. It will 100% cause problems if it shows as filed as single. Make the amendment as others suggested, looks like you have enough time to make the correction.
