Hi All, 

I've been approved for K1 visa last month March 2017( its gonna expire on June 2017 , valid only for 3mo.) I just had a baby here in canada last month(march2017) 

 

My Question is: 

* Baby is a  canadian citizen, can i just apply for the babys canadian passport and go in the USA to marry my fiancee ??because im worried that my K1 visa (was approved last March 2017) is expiring soon(June2017)and i dont know how long will it take to process the CRBA here in canada (i've checked online the latest available for interview schedule in mid May2017). The dad is a US citizen (born in US & still working there)

If the criteria have been met for the baby to be a USC then the child must travel into the USA with a US passport by law. 

 

You can apply for the passport at the same time as the CRBA.

Your question entangeles a lot of immigration and citizenship procedures and can not be answered in one sentence. You basicly have 3 options:

 

1) CRBA (which only can be done outside the US)

This is also the easiest way and your baby will get a US passport. The consulate can even issue an emergency passport on the same day. Call them, contact them by email, they should somehow get you an earlier appointment. Also the issuance of a CRBA will get your child a document that can substitute as a US birth certificate.

 

2) Travel to the US on a Canadian Passport

Your child could be denied entry to the US, since you are entering on an immigrant visa and your child lacks proper documentation. This can lead then to a major issue for both of you, since you will probaly not enter the US without your child and you would jeopardize your K1 visa. If you are able to enter the US eventhough concerning the above isse, you can just go to together with the father to a passport agency and apply for a US Passport there. It is the same process as a CRBA (i.e. the father will have to fulfill the physical presence requirements), but only a passport and no CRBA will be issued.

 

3) File a seperate petiton for your child

Not going to work, since your child has a USC father and this way no visa will be issued by the consulate.

 

Considering all this, just GET A CRBA.

It's amazing how many questions can be resolved with a 2 minute Google search...

No passport required for land entry of minors, just proof of citizenship. So they could save a bit of time there.

Hello visa journey family i need help with this am a U.S Citizen and my fiance just give birth abroad.

i have file for K1 and K2 Fiance(e) Visa 

I want to know if i can apply for Birth abroad for my child when she get to the states with the K2 visa

Or if i can apply U.S. Citizenship her when she get here....

Any advice and suggestions are welcome ...

Your baby is most likely a USC by birth. Because of this, the K2 visa will be denied and you will have to do a CRBA with the local embassy abroad (this is also the more easier and faster and cheaper option).

It's amazing how many questions can be resolved with a 2 minute Google search...

Hi guys! 

Thanks so much for all  the advice. Well i just decided to just do it here in canada (the crba,passport &ssn) for less hasselle i just have to inform them about the situation of my K1 visa that has been approved and will expire on june. I emailed and ask the embassy here but im still waiting for thier reply. So i just book an appointment to be sure(better book right away coz spots for interview gets full quicker). Its a headache being far from my fiancee hes missing a lot already with our baby(baby is one month now) i cant wait to have my whole family together! Pls pray and good luck to us all .. we all deserve to be with our loveones! :) thanks again..
