hi everybody- i will be starting this phase of the immigration journey and i was wondering about something. I am hearing that after 2 years of marriage that my spouse will receive his greencard. It will be 2 years this July so should I wait to file the AOS after our 2 year anniversary or before? My husbands K3 will expire April 2009.

If at time of approval, it has been over 2 years, then your husband will get a 10 yr green card.

It is april, some people have been approved in 2... 3 months... so you might want to wait another month or so ? That's just my opinion.

The average waiting time now is of about 4 to 6 months.. it can take longer, but it can take 2 months... so you might wanna consider waiting a little longer, to make sure that you can get a 10 yr green card and not have to deal with USCIS anymore until citizenship.

If you have been married for 2 years or more when you have your AOS interview you should be given a 10 years Greencard with no conditions....

If you have been married for less than 2 years at the AOS interview you will be given a 2 year conditional Greencard and you will have to file 1 year and 9 months later to remove the conditions....

If you can wait to file until after you have been married 2 years then I would do so that way you are saving the cost of removing the conditions... as you have a valid K3 you are safe to do this but remember that the initial medical was only valid for 12 months and you will need to have a full medical re-done when you file for AOS...

File just after your 2 year wedding anniversary , that way when they do issue the Green-Card, it should be the permanent one rather than the 2 year conditional one, then no need to remove the conditions later on.

File just after your 2 year wedding anniversary , that way when they do issue the Green-Card, it should be the permanent one rather than the 2 year conditional one, then no need to remove the conditions later on.

Followup questions in regards to waiting until after our 2yr wedding anniversary before filing aos. My wife and I could wait and file AOS April 2008, her K3 is valid until Dec 2008 and we have the 90 day dora program here in Dallas with infopass filing. The only hesitation I have is two fold.

1. I keep hearing from several people about the i-485 AOS fee going to $900 plus in the future, any news on this?

2. I hear that your original immigrant petition I-130 approval expires 1 yr from the approval date? is this accurate?

900 DOLLARS!!! OMG now that is very scary, hopefully it wont go that much up in a few months. As to the I130- our I130 is still being processed- it has never officially been approved. My husband came here on a K3, so I have no deadline for my I130 to expire as of yet. The K3 is good for 2 years. So if we can file the AOS after our 2 year anniversary and eliminate the lifting of conditions, I feel that would be our rest route to take so we can get the government out of our lives...lol

You know you don't have to wait for the I-130 to be approved before you filed for AOS right?

I just wanted to make sure if it was in our best interest to wait to file the AOS after our 2nd anniversary so we can eliminate the lifting conditions of AOS. If that is true, we will file AOS this July so my husband will receive his greencard without limitations.
