Can I expedite EAD???

Good Morning All!

 

I need advice,  hope my fellow VJs can help me.  My husband came in a K-1 visa and I showed proof that I am able to support him for the time being.  We married, however, I am now running into financial hardship due to having to buy a new car since mines broke down and buying text books since I started my master’s program. Him and I live on our own and I am taking care of things on my own as well, however, I am falling short on money due to these unforeseen expenses.  Do anyone know if I can file for financial hardship and it will not affect the AOS application in the long run?  Can I expedite the EAD card due to my personal financial hardship?  I can show through my credit card statement the down payment of the car that I had to purchase and how I had no more credit left in my credit card and my bank statements show how low I have been with money lately due to school expenses. 

 

My husband also signed up for LYFT and UBER so he can drive while I am at work, however, we are in need of the EAD so he can start driving.  Can this be considered a job offer?

Also signing up for the Uber thing don't think qualifies as a job offer.

I would agree, Uber and Lyft probably do not qualify as job offers

 

Especially since your husband would need to have a valid US licence in order to drive for them.....When does his current licence expire? Many states do not even issue a DL before the EAD/AP is received, and often the expiration date is set to the last day of authorized stay.

He does have a valid US license.  He took his Drivers Test and all, the car is even co owned by the both of us.

Driving for Lyft or Uber would not be a job offer. They don't classify their drivers as employees.

 

You can try to expedite due to a financial hardship. I'm doubtful it would be approved due to having to buy a car, though (and having to buy books is an expected expense).

You can certainly request an expedite by calling customer service or making an info pass but you'll need to prove severe financial loss, which would be more than normal everyday financial problems. EAD's are normally issued within 60 days.

It's closer to 90-120 days currently (leaning more towards the 120 side of things, actually).

If it's been more than 75 days since you applied for the EAD, call CS and submit a service request. My EAD took less than 60 days but I know that's just one experience.

U can expedite with a job offer letter only.

I expedited it. Agent told me to wait for a case number in my e-mail within 5 days. I then send out a consent request with all my evidence to my congress men. Nothing wrong with trying. Fingers crossed.

We expedited a renewal EAD on the basis of financial hardship with a new car purchase and cc statements and his paycheck

from his work so it is a bit different since it is a renewal but it may work for you with a job offer only since it's the initial EAD.
In our case I made a call to USCIS and the agent put in a expedited request, he said we do need a reason to base the request on and I said financial hardship. We received a letter requesting evidence for the financial hardship and to fax it to the number provided.
Since he would be a sub contractor

maybe the company can still give him a letter, not sure how Uber jobs work. Definitely worth a try.

I just read your last post, so did the agent ask you on what basis you want to expedite or if a job offer is enough ?

The agent did not ask, he said he will put in the request as financial hardship after I explained to him my issue.  I also then send my congressman my bank statement and showing my 3 credit cards maxed out along with my last 3 pay stubs from both my jobs.

I hate saying this but poor planning and living beyond what you can afford rarely causes uscis to move any faster.

We put in for an expedite on 4/3/17 due to financial hardships. When my husband first got here money was not a problem. Then we had a baby and baby had an emergency surgery at 2 months and I was diagnosed with multiple medical issues. Then I got hit with astronomical medical fees for both me and baby on top of husbands dental work. My deductible is $3000 per person with an out of pocket of $5500 per person. Even with a health spending account which I contributed the max our bills have been over $10,000. I lost $5500 in pay while out on maternity leave and had to pay benefits out of pocket back to employer. Savings slowly disappeared to cover everything and then catch up. We got paperwork requesting proof on 4/8/17. I faxed letter and bills over on 4/10/17 as proof. Today I got text saying card was being produced so USCIS moved pretty quickly and was understanding.
