Greetings all,

I am happy to find this forum with other couples taking the same journey! My husband and I were married on Feb 3, 2017 in the Dominican Republic. I'm American, he is Dominican. We filed the I-130 petition on 4/8/17. We are awaiting the NOA to file for a K3. I wanted to know if anyone had success with filing for a K3/I-129 and getting your spouse here sooner?  We are newbies to the immigration process and it seems from what I read & researched the I-130 takes nearly a year or more. I also read the I-130 is just the first step of many to complete before my husband can legally come to the USA:(. We are filing everything without a lawyer mainly because all of our funds are going to visa fees and travel fees for me and maintaining 2 different household expenses in 2 different countries while we go through this process. It's wholeheartedly difficult and expensive to be away from each other but we pray everyday that this will be over soon.....

 

My questions :

1 Has anyone had success with filing for a K3/I-129?

2 Can someone lay out all the forms that I need to file?

        I-130, DS-260 etc?

3 Can someone please share their experience after getting full I-130 approval how much longer did it take to complete the rest of the process?

Tips and suggestions are much appreciated!

I'm sorry to say that you won't get any, the k3 is practically obsolete nowadays, even if the form is approved, when it gets to the NVC stage, immigration closes it administratively to continue the consular processing

I filed a K3 in August 2016 and my i-130 was approved March 15, 2017 without any RFEs. Unfortunately the K3 is obselete at this time. I got a notification 3 days before my approval notice of the i-130.The notification was for the i-129f it said it was administratively closed becaue alien received another benefit. THe i-130 had been approved and the i-129f was joined together into my file. But if you still want to try you need to follow these steps.

 

 

1. File the i-130 in the packet you should have 

-Fee Payment 

- Form i-130

- Evidence of Petitioner's U.S. citizenship (all pages of passport)

- Copy of Birth certificate (Petitioner)

- Copy of Marriage Certificate 

- G-325A(Petitioner) 

- Passport photo (Petitioner )

- G-325A (beneficiary)

- Passport Photo (Beneficiary)

- Evidence of bonafide marriage (I sent affidavits from our family)

 

After you have sent that wait for the NOA 1 of the i-130 to include in the next packet,

Include in the next packet the following 

- NOA 1 from the i-130

- i- 129F 

- I-129F supplement for question 34.a explanation of meeting in person

- G-325A and passport style photo (Petitioner)

- G-325A and passport style photo (Beneficiary) 

- Birth certificate or passport (Petitioner

- copy of marriage certificate 

- proof of having met in person in the past two years (plane tickets, luggage tags , itineraries , photos together)

You can also include other information such as proof of an ongoing relationship(messages, call logs emails) and other things )

I also included photos from our wedding.

Yes, people have succeeded in doing so. However, K-3 is obsolete and hardly ever issued anymore. It was common back when the CR-1/IR-1 visa was taking years to process. The I-130 will remain open and you will continue with a CR-1/IR-1 visa.

Hi... you and I are filing the exact petition. I am currently at the NVC state. The I129 for is obsolete so there is really no need to file. Your best bet is to wait it out, I know its hard. I am filing my paperwork myself and this is what I did...

Since you already filed the I-130 wait for the NOA, you can check you case status online. I would setup an account with them so if there is a notification or change with your case they will send you an email and a text. My NOA never made it to my house via mail and the only way I knew our petition was approved was by checking this method. It took them about 5 months to the tee to approve our petition. Once that is done in about a week or so they send your application to the department of state for consular processing. 

 

Once thing that I read somewhere was to make an EXACT copy of your I-130 petition, it will come in handy later on. Sure enough it did... 

 

Once your petition is received by the Dept of state they will send you a notification, in my case an email. There you will get a case number and invoice number to pay your affidavit of support fees, $120 and to establish a representative. This can be yourself... 

 

Once that is done and processed in about 1 week you will get another invoice for the visa application fee $325. Once that is done you will have to complete the visa application or form DS-260 online, print your confirmation and you can also print your application.  Once that is done gather your financial records and complete your affidavit of support either the I864 or I864EZ if you have sufficient income.  The NVC website gives you step by step on what to do and what documents to get. In the meantime you can have your husband get a copy of his birth certificate "ACTA INEXTENSA" and a copy of his police record "BUENA CONDUCTA" he can email that to you since you only need a copy. Have those documents translated. 

 

Once you complete your financial documents, gather all the visa application documents. Remember when I said it was best to take a copy of the I130 ? This is when it comes in handy because you have everything you need with that petition just make a copy of whatever docs you need to send them. Once you have your financial and the visa application docs you have to mail it to the NVC.  Dont forget the cover letter.... (it comes with the invoices)

 

Once that is done you wait for them to process and wait for the interview... 

 

They should email or mail you the appointment letter once that is done email it to your husband so he can register with the consulate, get the medical, finger prints etc etc. He cant do any of that without. 

 

Also... make sure you make copies of the documents you send to the NVC. You will need it for our interview.

 

I have read that you do not have to be present with your spouse for the interview however I am going because this is a very important time for my husband and I want to be there. You decided what is best for you... 

 

After this I should go work for immigration because I feel I know them inside out, backwards and forwards LOL. JK JK I hope this helps you and I wish you the best of luck.
