Hello Folks,

 

I am new on this forum and I hope that I am putting this question at the right section.

Can someone please guide me to this issue.

 

My Father who is a USA citizen sponsored me as a Married Child over 21 in August 2006 under F3 category.

Received the letter of confirmation from NVC about case acceptance in October 2008

My daughter will be turning 21 August 2017.

 

Question:-

1) Will my daughter be covered under CSPA act?

2) Do I need to apply for CSPA or this is automatic?

1.  CSPA may or may not cover your daughter.  Google "CSPA calculator,"  You will need the Priority Date and I-130 approval date.  The time in between those two dates are not counted against your child.  If the time between the PD and I-130 approval date is 2 years, then your daughter gets an extra two years after age 21 under CSPA.

 

2.  Don't expect it to be automatic.  You may have to inform the NVC or US Embassy AFTER your PD becomes current.  The NVC and US Embassy will not do a CSPA calculation until AFTER your PD becomes current.
